The Ministry of Agriculture and Rural Development issued Decision 174/QD-BNN-BVTV dated January 9, 2023 announcing amended and supplemented administrative procedures in the field of plant protection and cultivation within the scope of management functions of the Ministry of Agriculture and Rural Development

1. Conditions for carrying out procedures for granting certificates of eligibility for fertilizer production in Vietnam

Conditions for issuance of Certificate of eligibility for fertilizer production include:

- Have a production location and factory area suitable for production scale: The production area has walls and fences separating it from the outside; a factory with a solid structure; Walls, ceilings, partitions, and doors ensure quality control requirements.

- Have lines, machinery, and equipment suitable for the production process of each type and form of fertilizer: Fertilizer production lines, machinery, and equipment must be consistent with the production process of each type of fertilizer and form of fertilizer specified in Appendix II of Decree 84/2019/ND-CP.

- Have a testing laboratory or have a contract with a designated testing organization to evaluate the quality criteria of the fertilizers they produce:

Have a testing laboratory recognized in accordance with ISO 17025 standards or have a contract with a designated testing organization in accordance with the law on product and goods quality except for establishments that only pack fertilizer.

- Have a quality management system that is appropriate and updated with standards issued by the international standardization organization on quality management:

Have a quality management system recognized in accordance with ISO 9001 or equivalent for newly established establishments no later than 01 year from the date of issuance of the Certificate of eligibility for fertilizer production.

- Have separate raw material storage areas and finished product areas;

- The person directly managing production must have a university degree or higher in one of the majors in cultivation, plant protection, soil agrochemistry, soil science, agronomy, chemistry, or biology.

2. Documents for carrying out procedures for granting certificates of eligibility for fertilizer production

- Application for issuance of Certificate of eligibility for fertilizer production (Appendix I to Decree 130/2022/ND-CP);

- Explanation of fertilizer production conditions (Form No. 09, Appendix I, Decree 84/2019/ND-CP.

Application include:

- Application for issuance of Certificate of eligibility for fertilizer production according to Appendix I of Decree 130/2022/ND-CP.

- Explanation of fertilizer production conditions according to Form No. 09 in Appendix I of Decree 84/2019/ND-CP.

- A photocopy of a university diploma or higher of the person directly managing production as prescribed in Point e, Clause 2, Article 41 of the Law on Crop Production.

Note:

- In case of submitting the application directly via postal service: The application components must be the original, a copy from the master book, a certified copy, or a copy submitted to present the original for comparison.

- In case of submitting an application via the online environment: application components must be scanned and taken from the original.

3. Procedures for issuance of Certificate of eligibility for fertilizer production

- Step 1: Organizations and individuals send 01 set of documents to the Plant Protection Department.

- Step 2: Answer the completeness of the application components:

In case of direct application: the Plant Protection Department checks the composition of the application and responds immediately when the organization or individual comes to submit the application;

In case of submitting application via postal service or online environment:
Within no more than 02 working days, the Plant Protection Department reviews its completeness. If the dossier is not complete according to regulations, the Plant Protection Department returns the dossier and notifies the organization or individual for additional information.

- Step 3: The Plant Protection Department organizes a physical inspection at the fertilizer production facility and prepares an inspection record.

Within 20 working days from the date of receipt of the complete dossier, the Plant Protection Department will appraise the dossier content, if the application meets the requirements, carry out an actual inspection of fertilizer production conditions, fulfill the obligations of organizations and individuals producing fertilizers according to the provisions of Point i, Clause 2, Article 50 of the Law on Crop Production, and prepare inspection records according to Form No. 12, Appendix I, Decree 84/2019/ND-CP.

In case an organization or individual producing fertilizer does not meet the conditions, it must take remedial action. After remediation, a written notification will be sent to the Plant Protection Department to organize an inspection of the remedied content.

In case the inspection results meet the requirements, within 05 working days from the date of completion of the inspection, the competent authority shall issue a Certificate of eligibility for fertilizer production according to Form No. 10 in Appendix I issued together with Decree 84/2019/ND-CP. In the event that a Certificate of eligibility for fertilizer production is not issued, a written response must be provided clearly stating the reason.

4. Fees and charges for issuance of Certificate of eligibility for fertilizer production

- Fee for appraisal and issuance of a certificate of eligibility for fertilizer production (except for establishments that only operate in fertilizer packaging): 6,000,000 VND/01 establishment/time.

- Fee for appraisal and issuance of a certificate of eligibility for fertilizer production for establishments that only pack fertilizer: 3,000,000 VND/01 establishment/time.

Decision 174/QD-BNN-BVTV takes effect on January 9, 2023.
