Procedures for changes in information about the remanufacturing code holder in Vietnam (Internet image) 

On December 11, 2023, the Ministry of Industry and Trade of Vietnam issued Decision 3185/QD-BCT announcing newly issued administrative procedures related to import and export under the Ministry of Industry and Trade.

Procedures for changes in information about the remanufacturing code holder in Vietnam

(1) Procedure

- Step 1: The refurbishing enterprise or trademark owner (hereinafter referred to as the requesting enterprise) sends 01 set of application documents to the Ministry of Industry and Trade.

- Step 2: The Ministry of Industry and Trade checks the validity and completeness of the dossier.

- Step 3: In case the application for amending and supplementing information is only related to Appendix IV of Decree 77/2023/ND-CP, if the modification or addition of information does not affect the refurbishment capacity, warranty, or right to use the trademark, within 07 working days from the date of receipt of the prescribed documents, the Ministry of Industry and Trade shall issue a written notice accepting the request to amend and supplement information.

For application of changes to information related to Appendix I, Appendix II, Appendix III, Appendix V of Decree 77/2023/ND-CP, within 07 working days from the date of receiving the prescribed dossier, the Ministry of Industry and Trade shall send the dossier to get opinions from the specialized management ministry.

- Step 4: Within 10 working days from the date of receiving the dossier from the Ministry of Industry and Trade, the specialized management ministry will respond in writing to the Ministry of Industry and Trade.

- Step 5: If the specialized management department concludes that the modification or supplementation of information does not affect the refurbishment capacity, warranty policy and right to use the trademark, wthin 07 working days from the date of receiving the written response from the specialized management ministry, the Ministry of Industry and Trade shall issue a written notice accepting the request to amend and supplement information.

In case the Ministry of Industry and Trade or a specialized management ministry finds that the modification or supplementation of information has the potential to affect the remanufacturing code holder's refurbishment capacity, warranty policy and right to use the trademark, within 07 working days from the date of receiving the prescribed documents or from the date of receiving the written response from the specialized management ministry, the Ministry of Industry and Trade shall notify the remanufacturing code holder in writing about the re-evaluation of capacity.

(2) Submission methods: Submit application by mail or online (if applicable).

(3) Document components:

Documents include:

- Application for amending and supplementing information according to the form in Appendix IX issued with Decree 77/2023/ND-CP (01 original copy).

- Explanatory documents requesting amendments and supplements to information (01 original in English and 01 Vietnamese translation, both signed by an authorized representative of the enterprise).

- Copies of supporting documents for explanatory documents, if any (01 copy of each document accompanied by a Vietnamese translation, both copies authenticated by an authorized representative of the enterprise).

(4) Processing time limit:

- 07 working days from the date of receiving the complete required documents from the enterprise or from the date of receiving the appraisal document from the specialized management ministry.
