Preferential Regime for Persons Engaging in Revolutionary Activities from January 1, 1945, to August 1945 Revolution

The Ordinance on Incentives for Revolutionary Contributors amended in 2012 was promulgated on July 16, 2012. One of the basic contents in this document is the amendment and supplementation of policies for individuals who participated in revolutionary activities from January 1, 1945, to the August Revolution in 1945.

To be specific, according to Clause 5 Article 1 of the 2012 Ordinance on Amendments and Supplements to the Ordinance on Preferences for Persons with Meritorious Services to the Revolution, amending and supplementing Article 10 of the 2005 Ordinance on Preferences for Persons with Meritorious Services to the Revolution, the preferential policies for people participating in revolutionary activities from January 1, 1945, to the August Revolution in 1945 are stipulated as follows:

- A person participating in revolutionary activities from January 1, 1945, to the August Revolution in 1945 is a person recognized by competent authorities to have led a revolutionary mass organization at the communal level or to have participated in revolutionary activities from January 1, 1945, to the August Revolution in 1945.

- The preferential policies for people participating in revolutionary activities from January 1, 1945, to the August Revolution in 1945 include:

- Monthly allowances;- Health insurance; annual health recovery and convalescence; provision of necessary assistive devices and orthopedic instruments;- Provision of funds to purchase the People's Newspaper; facilitation in participating in appropriate cultural and spiritual activities;- Housing improvement support based on the merits and circumstances of each person, the capacities of the State, and localities.

- The preferential policies when a person participating in revolutionary activities from January 1, 1945, to the August Revolution in 1945 passes away include:

- If a person participating in revolutionary activities from January 1, 1945, to the August Revolution in 1945, who is receiving preferential benefits as prescribed, dies, the funeral organizer is entitled to funeral expenses, and the relatives are entitled to an allowance;- If a person participating in revolutionary activities from January 1, 1945, to the August Revolution in 1945 dies without having received preferential policies as prescribed, the relatives are entitled to a one-time allowance;- Biological father, biological mother; spouse; children under 18 years old or 18 years old and above if still continuing their education or severely disabled, extremely severely disabled are entitled to a monthly survivorship allowance.

In case the biological father, biological mother; spouse living alone without support; orphaned child under 18 years old or 18 years old and above if still continuing their education or severely disabled, extremely severely disabled are entitled to an additional monthly support survivorship allowance;

- Biological father, biological mother; spouse; children from 6 years to under 18 years old or 18 years old and above if still continuing their education or severely disabled, extremely severely disabled are provided health insurance by the State.

- Children of people participating in revolutionary activities from January 1, 1945, to the August Revolution in 1945 are entitled to preferential policies and support as stipulated in Clause 5 Article 4 of the 2005 Ordinance on Preferences for Persons with Meritorious Services to the Revolution.

- People who have been recognized and benefiting from preferential policies as stipulated in Article 9 of the 2005 Ordinance on Preferences for Persons with Meritorious Services to the Revolution are not subject to the application of these provisions.

- The Government of Vietnam stipulates specific conditions and standards to recognize people participating in revolutionary activities from January 1, 1945, to the August Revolution in 1945.
