New Regulations on the Responsibilities of Radiation and Nuclear Safety Management Agencies

Recently, Circular 13/2018/TT-BKHCN was issued by the Ministry of Science and Technology to amend and supplement certain provisions of Joint Circular 13/2014/TTLT-BKHCN-BYT stipulating radiation safety in healthcare.

Circular 13 amending and supplementing the responsibilities of radiation and nuclear safety management agencies as follows:

1. The Department of Radiation and Nuclear Safety under the Ministry of Science and Technology is responsible for managing radiation safety in medical facilities nationwide, including:

- Receiving declarations regarding equipment containing radiation sources for diagnostic imaging, radiotherapy equipment, sealed radiation sources, and radiopharmaceuticals;- Evaluating safety, issuing licenses for radiation practices involving the use of equipment containing radiation sources for diagnostic imaging, operating radiotherapy equipment, storing and using radiation sources and radiopharmaceuticals, handling and storing used sealed radiation sources, constructing or changing the scale and scope of radiotherapy facilities, terminating the operation of radiotherapy facilities, and issuing radiation personnel certificates as per authority;- Inspecting, handling violations; presiding and cooperating with functional units of the Ministry of Health to check compliance with legal regulations on ensuring radiation safety in medical practice.

2. Departments of Science and Technology of centrally-governed provinces and cities are responsible for managing radiation safety in medical facilities operating within their jurisdictions, including:

- Receiving declarations regarding diagnostic X-ray equipment in medical practice;- Evaluating safety, issuing licenses for radiation practices using diagnostic X-ray equipment in medical practice, and issuing radiation personnel certificates to safety officers in medical facilities as per authority;- Inspecting, handling violations; presiding and cooperating with Departments of Health to check compliance with legal regulations on ensuring radiation safety in medical practice within their jurisdictions;- Coordinating with the Military Medical Department under the Ministry of National Defense in evaluating safety, issuing radiation work permits, and inspecting and checking the use of diagnostic X-ray equipment in medical facilities within their jurisdictions.

Circular 13/2018/TT-BKHCN takes effect from November 01, 2018.
