Military Service 2017: Compilation of Cases Eligible for Postponement, Exemption

Only 2 days left until the military service (NVQS) health examination time for the enlistment period in February and March 2017. Issues related to exemption and temporary postponement of NVQS are always a concern for families as well as young people. Hereafter, Thu Ky Luat would like to summarize all cases of temporary postponement and exemption from NVQS 2017.

I. 06 cases exempted from Military Service in 2017

According to the provisions of the law, there are currently the following cases exempted from military service implementation:

  1. Not meeting health standards:

10 medical conditions exempted from military service in 2017

- Mental illnesses (ICD10 code: F20-F29);- Epilepsy (ICD10 code: G40);- Parkinson's disease (ICD10 code: G20);- Blindness in one eye (ICD10 code: H54.4);- Deafness (ICD10 code: H90);- Sequelae due to bone and joint tuberculosis (ICD10 code: B90.2);- Sequelae due to leprosy (ICD10 code: B92);- Malignant diseases (ICD10 codes: C00 to C97; D00 to D09; D45-D47);- HIV infection (ICD10 codes: B20 to B24, Z21);- People with severe and special severe disabilities.

According to point c, clause 3, Article 4 of Circular 140/2015/TT-BQP on the regulations for selection and calling citizens to enlist, those with health type 3 having refractive errors in the eyes (myopia of 1.5 diopters or more, hyperopia of all degrees), drug addiction, HIV, and AIDS, will not be called to join the army.

In addition, there are other diseases but a rigorous health check is mandatory. More details can be found in Appendix I - Classification of Health according to Physical and Illness, issued with Joint Circular 16/2016/TTLT-BYT-BQP;

  1. Children of martyrs, children of first-class war invalids;
  2. A sibling of a martyr;
  3. A child of a second-class war invalid; a child of a sick soldier with a labor capability reduction of 81% or more; a child of a person affected by Agent Orange with a labor capability reduction of 81% or more;
  4. People doing cryptographic work who are not military personnel, People's Police;
  5. Officials and public employees, youth volunteers mobilized to work in areas with extremely difficult socio-economic conditions according to legal regulations for 24 months or more.

II. 07 cases of postponing military service

According to the provisions of the 2015 Military Service Law and Circular 140/2015/TT-BQP on the regulation of selecting and calling citizens to enlist, citizens are allowed to postpone enlistment during peacetime if they fall into one of the following cases:

  1. Not physically qualified for active service according to the Health Examination Council's conclusion;
  2. Being the only laborer directly nurturing relatives who are no longer capable of working or are under the working age; in families significantly damaged by accidents, natural disasters, or dangerous epidemics as confirmed by the Commune People's Committee;
  3. A child of a sick soldier, a person affected by Agent Orange with a labor capability reduction of 61% to 80%;
  4. Having siblings who are non-commissioned officers or soldiers serving in active duty; non-commissioned officers, soldiers performing obligations in the People's Public Security;
  5. People in migration or population resettlement programs within the first 3 years in areas with extremely difficult conditions according to State socio-economic development projects decided by the Provincial People's Committee or higher;
  6. Officials and public employees, youth volunteers mobilized to work in areas with extremely difficult socio-economic conditions according to legal regulations;
  7. Currently studying at general education institutions; attending regular university programs at higher education institutions, and regular college programs at vocational education institutions during the duration of one course of study.
