Postponement of Military Conscription in Which Cases?

Only a little over a month remains until the time for medical examinations for citizens called for enlistment. There are many aspects related to the performance of military service obligations that young individuals are concerned about, particularly the postponement of enlistment. So, what does the law stipulate regarding this issue?

According to the regulations specified in the Military Service Law 2015 and Circular 140/2015/TT-BQP on the selection and conscription of citizens, citizens may be deferred from military service during peacetime if they fall under one of the following categories:

- Not sufficiently healthy to serve according to the conclusion of the Health Examination Council;- The only breadwinner who must directly support dependents who are incapable of working or below working age; in families severely affected by accidents, natural disasters, or dangerous epidemics as certified by the Commune People's Committee;- A child of war invalids, or persons affected by Agent Orange with a reduction in labor capability from 61% to 80%;- Having siblings currently serving as NCOs or soldiers in active service; NCOs or soldiers fulfilling their duty in the People’s Public Security;- Persons involved in migration or population dispersion within the first 3 years to especially difficult communes according to the State’s socio-economic development projects as decided by the Provincial People's Committee or higher;- Officials and public employees, youth volunteers mobilized to work in areas with especially difficult socio-economic conditions as per legal provisions;- Studying at primary education institutions; currently undergoing full-time higher education or college-level training at vocational education institutions during the duration of a training course of a certain educational level.

Therefore, if you fall under the above categories, you may be eligible for a deferment from military service. Under the current regulations, if male students who have been admitted to university only receive their admission notice but have not completed the enrollment procedures, if they receive a conscription order, they must comply with the conscription order. If a citizen receives a conscription order and an admission notice simultaneously, they must comply with the conscription order first.
