The Government of Vietnam issued Decree 16/2006/ND-CP providing the honor restoration, compensations, supports for agencies, organizations or individuals suffering damage due to their participation in national security protection.
Lump-sum supports for persons suffering the loss of lives in Vietnam
According to the provisions of Article 13 of Decree 16/2006/ND-CP, a lump-sum allowance for persons suffering the loss of lives due to participating in the protection of national security includes:
1. Reasonable costs for the treatment, nourishment, and care of the person who suffered loss of life before death.
2. Reasonable costs for funeral expenses.
3. Allowance for the family or lawful representative of the person who suffered loss of life.
In addition, this Decree stipulates the authority to decide the allowance for persons suffering the loss of lives due to participating in the protection of national security as follows:
- Based on the proposal of the Head of the specialized agency in charge of national security protection, the Director of the Department of Labor, War Invalids and Social Affairs of Vietnam where the person suffered loss of life shall consider and decide on the allowance for the person who suffered loss of life at no more than 10,000,000 (ten million) VND per case.
- Based on the proposal of the Minister of Public Security, the Minister of National Defense, the Minister of Labor, War Invalids and Social Affairs of Vietnam shall decide on the allowance for the person who suffered loss of life from 10,000,000 (ten million) VND upwards, but not exceeding 60,000,000 (sixty million) VND per case.
