Key Performance Indicators for the Service Purchase Agreement for Public-Utility Products in Road Management and Maintenance

Recently, the Ministry of Transport has issued Circular 31/2014/TT-BGTVT guiding the bidding, ordering of production, and provision of public utility products and services for the management and maintenance of road works using the central road maintenance fund.

At Article 8 of Circular 31/2014/TT-BGTVT which is amended by Clause 6 Article 1 of Circular 38/2017/TT-BGTVT, regulations on the criteria for public service product, service management, and road maintenance contracts include:

- Name of public service product, service;

- Quantity, volume;

- Quality and specifications;

- Price, unit price;

- Level of subsidy (if any);

- Quantity, volume of public service products, services that are subsidized;

- Contract value;

- Completion time;

- Delivery: time, place, method;

- Method of acceptance, payment;

- Responsibilities and obligations between the ordering agency and the manufacturer and supplier of public service products, services receiving orders;

- Responsibilities of the parties for contract violations and resolution procedures.

The parties can agree to supplement other content in the contract as long as it is not contrary to the law and does not exceed the approved price for public service products, services management, and road maintenance.

Based on the national highway maintenance plan assigned by the Minister of Transport and the approved public service product prices, the agencies and units directly managing road infrastructure assets shall sign ordering contracts with organizations and individuals performing the production and supply of public service products, services management, and road maintenance according to the regulations in Chapter III of Decree 130/2013/ND-CP.
