On November 15, 2024, the Minister of Public Security of Vietnam promulgated Circular 83/2024/TT-BCA, regulating the construction, management, operation, exploitation, and use of the surveillance system ensuring security, order, and road traffic safety.

Guidelines on the protection of road traffic surveillance system in Vietnam from January 1, 2025

According to the provisions in Article 9 of Circular 83/2024/TT-BCA, the protection of the road traffic surveillance system is carried out as follows:

- Units managing and operating the traffic surveillance system implement measures to prevent, deter, and handle acts of system infringement. In cases where the traffic surveillance system is found to be infringed upon, protective measures must be taken, and the unit managing and operating the surveillance system must be promptly reported to handle the situation in accordance with legal provisions.

- The police of units and localities with equipment and infrastructure of the surveillance system located within their management area are responsible for cooperating with the units managing and operating the traffic surveillance system to implement measures to prevent, deter, and handle acts of system infringement.

Additionally, funding sources for the construction, upgrading, management, operation, exploitation, use, maintenance, and repair of the traffic surveillance system are specifically stipulated in Article 12 of Circular 83/2024/TT-BCA as follows:

- Funding used for construction, upgrading, management, operation, exploitation, use, maintenance, and repair of the traffic surveillance system is ensured from the state budget and other lawful funding sources as regulated by law.

- The Traffic Police Department, the police of central-affiliated cities and provinces prepare budgets, manage, use, and settle funds used for the construction, upgrading, management, operation, exploitation, use, maintenance, and repair of the traffic surveillance system in accordance with legal regulations.

- The Planning and Finance Department advises and reports to the Ministry's leadership to ensure funding and guides the police of units and localities in preparing budgets, managing, and using allocated funds for constructing, upgrading, managing, operating, exploiting, using, maintaining, and repairing the traffic surveillance system.

Regulations on building the road traffic surveillance system in Vietnam from January 1, 2025

The construction of the road traffic surveillance system is executed in accordance with the provisions in Article 5 of Circular 83/2024/TT-BCA as follows:

- The construction of traffic surveillance systems must adhere to the National Technical Regulations on systems ensuring security, order, and road traffic safety, and the following requirements:

+ Ensure timely, efficient, and economical implementation; prioritize the construction of traffic surveillance systems on highways, national roads, and roadways with complex security, order, and traffic safety conditions or of significant importance to economic, social, defense, and security development.

+ Prioritize using transmission infrastructure already built within the People's Public Security; if the transmission infrastructure within the People's Public Security does not meet requirements or has not been invested in, hire transmission infrastructure from service providers.

+ Meet practical demands, suit road traffic infrastructure; ensure integration and connectivity with already built traffic surveillance systems.

- The traffic surveillance system is designed to align with the Electronic Government Architecture Framework of Vietnam and the regulations of the Minister of Public Security on the management, connection, and sharing of surveillance camera data within the People's Public Security.

- The construction, upgrading, and software transfer of the traffic surveillance system must comply with the Minister of Public Security's regulations on the development, upgrading, transfer, and maintenance of software in the People's Public Security.

- Before being put into use, the traffic surveillance system must be inspected, evaluated, and ensured to meet technical and operational requirements.

Refer to the Circular 83/2024/TT-BCA, effective from January 1, 2025, replacing Circular 17/2014/TT-BCA of the Minister of Public Security regulating the operation, management, maintenance, and protection of the surveillance system, and the handling of road traffic order and safety violations.
