Guidelines for Handling Violations by Militia Commanders Regarding Responsibilities and Duties

To be specific: Article 9 of Circular 75/2020/TT-BQP stipulates the application of disciplinary forms, order, procedures, statute of limitations, time limits, and authority for handling disciplinary actions against the militia for violating duties and responsibilities of militia commanders as follows:

- The direct commander of the unit, the commune-level military command board, the military command board of agencies and organizations, due to lack of responsibility in management and command, allowing the subordinate militia to violate state laws to the extent that they are disciplined from a warning upwards or are prosecuted for criminal liability, will be disciplined with a reprimand or warning.

- The direct commander who knows or detects signs of violations by subordinate militia but does not promptly take preventive measures or covers up the subordinate's violations causing serious consequences or more will be disciplined with demotion or dismissal.

Moreover, Article 10 of Circular 75/2020/TT-BQP also stipulates violations of authority by militia commanders as follows:

- The person holding the position of militia commander who abuses their position and authority to violate principles and regulations or issues orders beyond their authority, will be disciplined with a reprimand or warning.

- Violations of any of the following cases will be disciplined with demotion or dismissal:

Utilising militia equipment and means to commit violations;

Being warned or reminded but still deliberately violating;

Having been disciplined but not recognized for improvement and continues to violate.
