1. Guidance on traffic accident classification in Vietnam from August 15, 2024

According to the specific provisions in Article 5 Circular 26/2024/TT-BCA, depending on the extent of damage to people and property, traffic accidents are classified into particularly serious traffic accidents, very serious traffic accidents, serious traffic accidents, less serious traffic accidents, and traffic collisions.

- A severe traffic accident falls under one of the following cases:

+ Causes death to 03 or more people;

+ Causes injury or harm to the health of 03 or more people with a total body injury rate of 201% or more;

+ Causes property damage of 1,500,000,000 VND or more.

- A very serious traffic accident falls under one of the following cases:

+ Causes death to 02 people;

+ Causes injury or harm to the health of 02 or more people with a total body injury rate from 122% to 200%;

+ Causes property damage from 500,000,000 VND to less than 1,500,000,000 VND.

- A serious traffic accident falls under one of the following cases:

+ Causes death to 01 person;

+ Causes injury or harm to the health of 01 person with a body injury rate of 61% or more;

+ Causes injury or harm to the health of 02 or more people with a total body injury rate from 61% to 121%;

+ Causes property damage from 100,000,000 VND to less than 500,000,000 VND.

- A less serious traffic accident falls under one of the following cases:

+ Causes injury or harm to the health of one person with a body injury rate from 11% to less than 61%;

+ Causes injury or harm to the health of 02 or more people with a total body injury rate from 11% to less than 61%;

+ Causes property damage from 10,000,000 VND to less than 100,000,000 VND.

- A traffic collision is a traffic accident causing consequences below the levels specified in clause 4, Article 5 Circular 26/2024/TT-BCA.

- The determination of the percentage of injury of persons injured due to traffic accidents is performed according to the provisions of Circular 22/2019/TT-BYT of the Minister of Health, which regulates the percentage of body injury used in forensic examination and psychiatric forensic examination.

- Determination of property damage caused by traffic accidents is based on the valuation conclusion of property damage, valuation certificate, or other documents of evidentiary value of property damage.

2. 08 Principles in Statistics, Compilation, and Building the Database on Traffic Accidents in Vietnam from August 15, 2024

08 principles in statistics, compilation, and building the Database on Traffic Accidents are stipulated in Article 4 Circular 26/2024/TT-BCA as follows:

- Ensure objectivity, honesty, accuracy, completeness, promptness, according to the progress of investigation, verification, resolution of traffic accidents, and other professional requirements.

- Consistency in statistical indicators, statistical forms; with analysis and comparison.

- No duplication, overlap between statistical information; statistical information must be fully reported according to the mandatory fields in the traffic accident report form specified in clause 1, Article 27 Circular 26/2024/TT-BCA.

- One or multiple successive collisions between traffic participants at a specific location are considered a single traffic accident. A traffic accident occurs to one or multiple traffic participants.

- Statistics of the number of deaths in a traffic accident include those who died and those who were injured due to the traffic accident leading to death within 07 days from the date of the accident; if the injured person dies beyond 07 days from the date of the traffic accident and there is a conclusion from the public forensic examination organization, it will be additionally reported.

- Statistics of the number of injuries in a traffic accident include those who need treatment and have medical records at medical facilities.

- In cases where traffic accident data previously reported has errors or new incidents, deaths, or injuries arise outside the reporting period, they are supplemented and the reason for adjustment or addition is clearly explained. The provincial police aggregate and report to the Ministry of Public Security (through the Traffic Police Department).

- Not infringing on national interests, lawful rights and interests of agencies, organizations, and individuals.

More details can be found in Circular 26/2024/TT-BCA which comes into force in Vietnam from August 15, 2024.
