Below are the regulations regarding the cases considered as severe traffic accidents according to Circular 26/2024/TT-BCA.

Regulations on cases considered as severe traffic accident in Vietnam

To be specific, Article 5 of Circular 26/2024/TT-BCA has detailed the classification of traffic accidents as follows:

Based on the extent of human and property damage, traffic accidents are categorized into traffic accidents causing particularly serious consequences, traffic accidents causing very serious consequences, traffic accidents causing serious consequences, traffic accidents causing minor consequences, and traffic collisions.

- Traffic accidents causing particularly serious consequences fall into one of the following cases:

+ Resulting in the death of 03 or more people;

+ Causing injury or harm to the health of 03 or more people, with the total body injury percentage of these individuals being 201% or more;

+ Causing property damage of 1,500,000,000 VND or more.

- Traffic accidents causing very serious consequences fall into one of the following cases:

+ Resulting in the death of 02 people;

+ Causing injury or harm to the health of 02 or more people, with the total body injury percentage of these individuals ranging from 122% to 200%;

+ Causing property damage from 500,000,000 VND to less than 1,500,000,000 VND.

- Traffic accidents causing serious consequences fall into one of the following cases:

+ Resulting in the death of 01 person;

+ Causing injury or harm to the health of 01 person with a body injury percentage of 61% or more;

+ Causing injury or harm to the health of 02 or more people, with the total body injury percentage of these individuals ranging from 61% to 121%;

+ Causing property damage from 100,000,000 VND to less than 500,000,000 VND.

- Traffic accidents causing minor consequences fall into one of the following cases:

+ Causing injury or harm to the health of one person with a body injury percentage ranging from 11% to less than 61%;

+ Causing injury or harm to the health of 02 or more people, with the total body injury percentage of these individuals ranging from 11% to less than 61%;

+ Causing property damage from 10,000,000 VND to less than 100,000,000 VND.

- A traffic collision is a traffic accident that results in consequences below the thresholds specified in Clause 4, Article 5 of Circular 26/2024/TT-BCA.

- The determination of the injury percentage caused by traffic accidents is carried out according to the provisions of Circular 22/2019/TT-BYT dated August 28, 2019, by the Minister of Health regarding the percentage of body injuries used in forensic and psychiatric forensic evaluations.

- The determination of property damage caused by traffic accidents is based on the conclusion of asset damage valuation, valuation certificates, or other documents evidencing asset damage.

Thus, according to the above regulations, cases considered as severe traffic accident include:

- Resulting in the death of 02 people

- Causing injury or harm to the health of 02 or more people, with the total body injury percentage of these individuals ranging from 122% to 200%

- Causing property damage from 500,000,000 VND to less than 1,500,000,000 VND.

Regulations on Common Statistical Indicators on Traffic Accidents in Vietnam

- Number of incidents, number of deaths, number of injuries.

- Road traffic safety coefficients

+ Road traffic safety coefficient per 100,000 population (people);

+ Road traffic safety coefficient per 10,000 vehicles (cars and motorcycles);

+ Road traffic safety coefficient per 1 kilometer (km) of road.
