From August 13, 2024, the organizational structure of the Vietnam’s National Medical Council is specified in Decision 827/QD-TTg.

On August 13, 2024, the Prime Minister of the Government of Vietnam issued Decision 827/QD-TTg on the establishment of the Vietnam’s National Medical Council.

Article 3 of Decision 827/QD-TTg regulates the organizational structure of the Vietnam’s National Medical Council from August 13, 2024, as follows:

(1) The Vietnam’s National Medical Council includes a President, no more than 03 Vice Presidents, and Council Members, wherein:

- The President of the Council is concurrently a Leader of the Ministry of Health.

- The Vice Presidents of the Council include: 01 Permanent Vice President working full-time, 01 Vice President who is concurrently the Director of the Department of Medical Examination and Treatment Management under the Ministry of Health, and 01 Vice President who is concurrently the Director of the Department of Science, Technology, and Training under the Ministry of Health.

The Prime Minister of the Government of Vietnam appoints and dismisses the President and Vice Presidents of the Vietnam’s National Medical Council upon the recommendation of the Minister of Health.

The term of the full-time Permanent Vice President is 05 years and can be reappointed, but not for more than 02 consecutive terms.

- The Council Members

Council Members include: representatives of medical examination and treatment facilities; representatives of health sector training institutions; representatives of professional associations and health sector experts; representatives of state management agencies, including 01 Member who concurrently acts as the Secretary of the Council. The number of Council Members is decided by the President of the Vietnam’s National Medical Council based on the actual needs of the Council.

Council Members of the Vietnam’s National Medical Council are appointed and dismissed by the President of the Vietnam’s National Medical Council and work in a concurrent capacity. Standards, conditions, and procedures for the appointment and dismissal of Council Members of the Vietnam’s National Medical Council are specified in the Organizational and Operational Regulations of the Vietnam’s National Medical Council issued by the Prime Minister of the Government of Vietnam.

(2) Specialized Committees

The Vietnam’s National Medical Council has specialized committees to carry out the tasks of the Council. Members of specialized committees include several Council Members and experts from hospitals, higher education institutions in the health sector, and professional associations in the health sector.

(3) Office of the Vietnam’s National Medical Council

The Vietnam’s National Medical Council has an assisting agency which is the Office of the Vietnam’s National Medical Council. The Office of the Vietnam’s National Medical Council is a public service provider under the Ministry of Health, established by the Minister of Health in accordance with the law.

Tasks of the Vietnam’s National Medical Council

According to Clause 2, Article 25 of the Law on Medical Examination and Treatment 2023, the Vietnam’s National Medical Council performs the following tasks:

- Preside over cooperation with social-professional organizations regarding medical examination and treatment, and other relevant agencies and organizations in developing a set of tools for evaluating medical examination and treatment practice competency;

- Issue the set of tools for evaluating medical examination and treatment practice competency;

- Preside over organizing the examination for evaluating medical examination and treatment practice competency;

- Receive and resolve petitions, complaints, or cooperate with state management agencies in resolving complaints and denunciations regarding the results of the examination for evaluating medical examination and treatment practice competency;

- Perform other tasks as prescribed by the Prime Minister of the Government of Vietnam.

More details can be found in Decision 827/QD-TTg, effective from August 13, 2024, and replacing Decision 956/QD-TTg of 2020.

Personnel of the Vietnam’s National Medical Council appointed before the effective date of Decision 827/QD-TTg will continue to perform their assigned responsibilities and tasks until a decision is made by the competent authority.
