On December 23, 2023, the Ministry of Home Affairs issued Official Dispatch 7583/BNV-TCBC, providing guidance on a number of problems in developing the Project and approving job positions.

Guidance on some problems in creating job positions

To carry out the development of the Project and approve the employment positions and structure of civil servants and public employees according to employment positions in agencies, administrative organizations, and public service units (ensuring planning, quality, and unity in the political system), the Ministry of Home Affairs guides ministries, branches, localities, and mass associations assigned tasks by the Party and State at the Central level on the following contents:

- The development of a list of job positions, job descriptions, and capacity frameworks for job positions should be under the unified direction of the Standing Committee of the Secretariat and the guidance of the Central Organizing Committee, ensuring compliance with the provisions of the Law on Cadres and Civil Servants, the Law on Public Employees, and guiding documents.

- Job positions need to be built with a high level of generalization according to the functions and tasks of each industry and field from central to local levels, taking into account the complexity, nature, characteristics, scale of operations, scope of subjects served, and professional and professional management processes of the job according to the functions and tasks corresponding to each civil servant rank and public employee professional title. Each job position has the following 3 components: (1) Job position name; (2) Job position description; (3) Job position competency framework, in which:

+ Job position name: Implemented uniformly according to the guidance of the Ministry managing the industry and field, ensuring unity, connectivity, and synchronization in the political system.

+ Job position description: Based on the general description according to the guiding Circular of the Ministry, managing the industry, field, ministries, branches, and localities needs a specific description appropriate to the specific work of the job position (attached to the product corresponding to the nature and complexity of the job position) according to the functions and tasks of each agency, organization, and unit.

+ Job position capacity framework: Based on the general capacity framework according to the guiding Circular of the Ministry managing the industry and field, ministries, branches, and localities need to specifically describe, in accordance with the requirements of improving the quality of officials, civil servants, and public employees, the work of the job position according to assigned functions and tasks.

- Based on the determination of the list of job positions of each agency, organization, and unit, the determination of the structure of civil servants and public employees by job position needs to meet the following requirements: (1) Inherit and gradually adjust to restructure and improve the quality of civil servants in administrative agencies and organizations; (2) In accordance with the professional title of public employee of a public service unit according to the guidance of the Ministry managing public service sectors and fields, ensuring to meet the requirements of improving the quality of public service services.

- Approving job positions and restructuring the team of cadres, civil servants, and public employees in agencies, administrative organizations, and public service units does not increase the payroll of the competent authority and associated with the roadmap for streamlining civil servant payrolls and reducing the payroll of public employees receiving salaries from the state budget, especially for public service agencies, it is necessary to implement synchronously with the Autonomy Project to gradually restructure the number of employees in the direction of increasing the number of people receiving salaries from non-business revenue sources corresponding to the level of self-guarantee of regular expenses of public service units according to Resolution No. 75/2022/QH15 dated November 15, 2022 of the National Assembly.

- In cases where the guiding Circulars of the Ministry managing sectors and fields do not cover all specific subjects, localities are requested to proactively identify job positions in accordance with functions, tasks, and temporary approvals; at the same time, send a proposed report to the Ministry of Home Affairs and ministries managing relevant sectors and fields for synthesis, research, and guidance according to their authority.
