Greetings Mr. Minh Tung, the issue you have raised has been addressed by Thu Ky Luat as follows:
According to the provisions of the Military Service Law 2015, the cases eligible for postponement of military enlistment include:
- Not having sufficient health to serve in active duty according to the conclusion of the Health Examination Council;- Being the sole laborer directly supporting family members who are incapacitated or not yet of working age; in families severely damaged in terms of persons and assets due to accidents, natural disasters, or dangerous epidemics as certified by the commune-level People's Committee;- Being the only child of war invalids or people affected by Agent Orange with a labor capacity decrease of 61% to 80%;- Having siblings who are non-commissioned officers or soldiers on active duty; non-commissioned officers or soldiers performing their duty to participate in the People's Police;- Falling within the category of migrants or dispersed population in the first 03 years to particularly difficult communes according to the State's socio-economic development project as decided by the provincial-level People's Committee or higher;- Being officials and public employees, or young volunteers assigned to work in areas with particularly difficult socio-economic conditions as prescribed by law;- Currently studying at an educational institution or being trained at a university level in a full-time program at a higher education institution, or a college level in a full-time program at a vocational education institution within the duration of one training course of one training level.
Citizens falling into the aforementioned cases, if the reason for postponement no longer exists, shall be called for enlistment.
Additionally, Article 30 of the Military Service Law 2015 and Clause 1 Article 4 of Circular 140/2015/TT-BQP stipulate the age for military enlistment as follows:
- The age for enlistment is from 18 years to 25 years;- Citizens who have been trained at a college or university level and have had their enlistment postponed, the age for enlistment extends to 27 years.
Thus, based on the above information, after graduating from university, you are no longer eligible for postponement of military service and you are still within the age for enlistment (citizens who have been trained at a college or university level and have had their enlistment postponed, the age for enlistment extends to 27 years). Therefore, when you receive the enlistment order, you must perform military service.
