Decision 31/2023/QD-UBND dated July 18, 2023 guiding the functions, tasks, powers and organization of the Department of Home Affairs under the People's Committee of Thu Duc City and districts - districts, Ho Chi Minh City.

The position and function of the Department of Home Affairs in Vietnam

Department of Home Affairs is a specialized agency under the People's Committee of Thu Duc city and the districts (hereinafter referred to as the People's Committee at district level), advise and assist the district-level People's Committees in performing the state management function on: organizational structure; employment positions, civil servant rank structure and civil servant payrolls in state administrative agencies and organizations; employment positions, the structure of public employees by professional titles and the number of people working in public non-business units; salaries for cadres, civil servants, public employees and contract workers in agencies, administrative organizations and public non-business units; administrative reform, civil service reform; local government; administrative boundaries; officials and civil servants; cadres and civil servants at commune level and those working part-time at commune level, in neighborhoods and hamlets (organizations under wards, communes and townships); associations, non-governmental organizations; records, state archives; religious beliefs; youth; emulation and reward.

The Department of Home Affairs has legal status, its own seal, and its own account; abide by the leadership and management of the organization, the staffing and work of the district-level People's Committee, and at the same time comply with the direction, inspection, and professional guidance of the Department of Home Affairs.

Tasks and powers of the Department of Home Affairs in Vietnam

1. Submitting to the district-level People's Committee:

- Promulgating decisions under the authority of district-level People's Committees:

Development planning and plans, programs, and measures to organize the performance of tasks related to the domestic sector and field in the locality;

Decentralizing and delegating the tasks of state management in the domestic sector to specialized agencies under the People's Committee of the district and the People's Committee of the commune;

Specifying the functions, tasks, powers, and organization of the Department of Home Affairs.

- Promulgating documents directing and guiding by branches and domains of internal affairs for agencies, organizations, and units in the area according to the Party's regulations, laws, and directions from superior state agencies.

2. Submitting to the Chairman of the district-level People's Committee for decision on the appointment of personnel within the competence of the chairperson of the district-level People's Committee in accordance with the Party's regulations and the law.

3. Organizing the implementation of legal documents, plannings, plans and programs after they are approved by competent authorities; guiding, examining, informing, propagating, disseminating, and educating the law, and monitoring law enforcement in the fields under the assigned scope of state management.

4. Regarding the organization of the apparatus:

- Advising and assisting the People's Committee of the district to submit to the People's Council of the district, the People's Council of Thu Duc City for consideration and decision on the establishment, reorganization,
dissolution of specialized agencies under the People's Committee of the district and the People's Committee of Thu Duc city.

Particularly for districts that carry out urban administration, the Department of Home Affairs advises and assists the Chairman of the district People's Committee to submit it to the People's Committee of Ho Chi Minh City (hereinafter referred to as the People's Committee of the City) to consider and decide on the establishment, reorganization, and dissolution of specialized agencies under the People's Committee of the district.

- Evaluation of draft documents:

Prescribing the functions, tasks, powers, and organization of administrative agencies (including specialized agencies and other administrative agencies), public non-business units under district-level People's Committees;

Establishment, reorganization, and dissolution of administrative organizations and public non-business units under the decision-making authority of the district-level People's Committees (unless specialized law provides otherwise for appraisal agencies);

Establishing, consolidating, merging, and dissolving inter-sectoral coordination organizations under the decision-making authority of district-level People's Committee chairpersons in accordance with law.

5. Regarding employment positions, civil servant payrolls, and civil servant rank structure:

- Appraisal of job position schemes, job position adjustment schemes, and civil servant rank structure of agencies and organizations under the management of district-level People's Committees; synthesize and submit to the district-level People's Committee for decision according to its competence; or submit to the City People's Committee for decision according to the provisions of law and the management decentralization of the City People's Committee.

- Advising and assisting the People's Committee of the district:

Appraisubf and submit to the City People's Committee the annual civil servant payroll plan or adjust the civil servant payroll belonging to the People's Council of Thu Duc city, the People's Council of the district, the People's Committee of the district, and the People's Committee of the wards, carry out urban administration;

To assign civil servant payrolls to agencies and organizations under the People's Council of Thu Duc City, the district People's Council, the district-level People's Committee, and the People's Committees of the wards shall perform the urban administration in proportion to the total number of civil servants assigned by the competent authorities and according to the management decentralization of the City People's Committee.

- Summarizing the structure of civil servant ranks of agencies and organizations under the People's Council of Thu Duc city, the People's Council of the district, the People's Committee of the district, and the People's Committee of the wards performing urban administration; summarizing the quantity and quality of commune-level cadres, communal civil servants, and part-timers working at the commune-level People's Committees and submitting them to the district-level People's Committees for submission to the Department of Home Affairs for general synthesis.

6. Regarding employment positions, the structure of public employees by professional title, and the number of people working in public non-business units:

- Appraisal of the project of job position, the project of adjustment of job position, and the structure of public employees
according to the professional titles of public non-business units that have not yet self-financed recurrent expenditures under the management of the district-level People's Committees. Submit to the People's Committee of the district for approval according to its competence, or submit to the People's Committee of the City for approval and adjustment of the job position and the structure of public employees according to the professional titles of the public non-business units has not yet been able to cover recurrent expenditures under its management.

- Advising and assisting the People's Committee of the district:

Appraising and submitting to the People's Committee of Ho Chi Minh City the plan on the number of people working for public non-business units that have not yet been able to self-finance recurrent expenditures under their management;

Deciding to assign and adjust the number of people working with salaries from the state budget for public non-business units that cover part of their recurrent expenditures, public non-business units with recurrent expenditures guaranteed by the State and the number of people working with salaries from non-business revenues, each non-business unit, self-finances a part of its recurrent expenditures under its management after being assigned by competent authorities and according to the management decentralization of the City People's Committee.

- Summarizing employment positions, the structure of public employees by professional title, and the number of people working in public non-business units according to the degree of financial autonomy under the management of the locality; submitting it to the People's Committee of the district to the Department of Home Affairs in accordance with law.

7. Regarding the implementation of salary regimes and policies, allowances, living expenses, bonuses, additional income, other support regimes prescribed by the People's Council of Ho Chi Minh City (hereinafter referred to as the City People's Council), and other incomes as prescribed by law for cadres, civil servants, public employees, contract workers in agencies, administrative organizations, public non-business units, and part-time workers in communes, wards, and townships:

Regarding the implementation of salary and allowance regimes and policies in accordance with the law; other incomes, living expenses, and bonuses for cadres, civil servants, public employees, contract workers in agencies, administrative organizations, public non-business units, and part-time workers in communes, wards, and townships.

- Advising and submitting to the President of the district-level People's Committee for decision according to their competence or requesting the competent authority to decide on the regular salary increase or raise the salary level ahead of time and implement the regimes and policies on wages, allowances, living expenses, bonuses, additional income, other support regimes prescribed by the City People's Council, and other incomes according to the provisions of law for cadres, civil servants, public employees, part-time workers in communes, wards, and townships, contract workers according to the provisions of law, and management decentralization of the City People's Committee.

- Guiding, examining, and settling according to their competence, or requesting competent authorities to solve problems in the implementation of salary regimes and policies, allowances, living expenses, bonuses, and additional income. , other support regimes prescribed by the City People's Council, and other incomes as prescribed by law for cadres, civil servants, public employees, part-time workers in communes, wards, and townships, contract workers in agencies, administrative organizations, and public non-business units in the locality according to the provisions of law and local management decentralization.

8. Regarding administrative reform, civil service reform:

- Advising and submitting to the People's Committee of the district:

Decisions or documents assigning agencies and units of the same level under the district-level People's Committees to assume the prime responsibility for, or coordinate in the implementation of the contents and tasks of the administrative reform, the reform of the civil servant and public service regime to complete the assigned tasks;

Deciding on measures and solutions to speed up administrative reform and the reform of the civil servant and public service regime in the locality; overcome limitations; and raise the annual PAR index.

- Advising and assisting district-level People's Committees: to monitor and inspect agencies and units of the same level and commune-level People's Committees to carry out administrative reform, reform of the civil service, and civil service regimes in the locality; commend and encourage collectives and individuals to achieve good results in administrative reform as prescribed.

9. Regarding local government:

- Advising and assisting the People's Committee of the district:

Deploying the election of deputies to the National Assembly and the People's Council of Ho Chi Minh City, to the People's Council of Thu Duc City, deputies of the People's Councils of the districts, and the People's Councils of communes and townships in the locality according to the provisions of law and the guidance of the superior agencies;

Submitting to the Chairman of the City People's Committee for appointment, dismissal, transfer, rotation, secondment, commendation, discipline, and suspension of the work of the Chairman, Vice Chairman of the People's Committee of the district; submit to the People's Council of Thu Duc City, the People's Council of the district, to elect, relieve, and dismiss the Chairman, Vice Chairman, and members of the People's Committee of Thu Duc City, the Chairman and Vice Chairman.
and members of the district People's Committee as prescribed by law;

Submitting to competent authorities for consideration and decision the establishment, dissolution, merger, and division of the neighborhood - hamlet; naming and renaming neighborhoods - hamlets in the area;

Implement democracy work at commune level and in state administrative agencies and public non-business units; the government's mass mobilization work is in accordance with the Party's regulations, the law, and the guidance of superior agencies.

- Appraising and submitting to the President of the People's Committee of the district for approval the results of election, relief from duty, and dismissal of the President and Vice President of the People's Committee of the commune; the mobilization, temporary suspension of work, and dismissal of chairmen and vice-chairmen of the commune-level People's Committees; and the assignment of the right to chairpersons of the commune-level People's Committees in accordance with law.

Particularly for districts implementing urban government, the Department of Home Affairs shall advise and assist the Chairman of the People's Committee of the district to appoint, re-appoint, extend the time holding the position, dismiss the Chairman, Vice Chairman of the People's Committee of the ward, mobilize, temporarily suspend work, dismiss the Chairman, Vice Chairman of the People's Committee of the ward, and assign the Chairman of the People's Committee of the ward according to the provisions of law.

- Advising and assisting the People's Committees and Presidents of the district-level People's Committees in performing the state management of the Quarter - hamlet according to the provisions of law and the local management decentralization.
