On March 29, 2016, the Ministry of Finance issued Circular 57/2016/TT-BTC providing guidance on policies for collection, accounting of contributions to the Vietnam Public Telecommunications Service Fund and the transfer of assets formed from the fund's expenses until 2020.
Financial Contribution Levels to the Public Telecommunication Service Fund - Illustrative Image
According to Article 3 of Circular 57/2016/TT-BTC, the financial contribution levels required from telecommunication enterprises providing services and possessing network infrastructure, and enterprises providing incoming international telephone services without a license for establishing a telecommunication network operating legally in Vietnam are stipulated as follows:
For enterprises providing services and possessing network infrastructure, the contribution rate is 1.5% of the revenue from services as specified in Article 9 of Decree 25/2011/ND-CP dated April 6, 2011, of the Government of Vietnam, detailing and guiding the implementation of certain articles of the Telecommunications Law and any amendments, supplements, or replacements thereto (if any).
For enterprises providing incoming international telephone services but not possessing a license for establishing a telecommunication network, the contribution rate is 1.5% of the revenue from this service.
The telecommunication service revenue serving as a basis for determining the contribution level to the Vietnam Public Telecommunication Service Fund is guided by Circular 21/2013/TT-BTTTT dated December 18, 2013, of the Ministry of Information and Communications, regulating telecommunication service revenue.
Concerning prepaid telecommunication services (telecommunication cards), if the enterprise has not determined the service revenue under the provisions of Circular 21/2013/TT-BTTTT, the telecommunication card revenue will be used to determine the contribution level to the Fund. The enterprise is responsible for clearly reporting the method of determining prepaid telecommunication service revenue to the Vietnam Public Telecommunication Service Fund as a basis for finalizing the collected amount for the year.
- Revenue from sources funded by the Vietnam Public Telecommunication Service Fund;- Revenue from entities subject to public telecommunication price policies;- Revenue from other public utility services.
Notice, enterprises are responsible for clearly reporting the public service revenue items to the Vietnam Public Telecommunication Service Fund as a basis for finalizing the collected amount for the year.
