This is an important content regulated by the Minister of Labor, Invalids and Social Affairs of Vietnam as stipulated in Circular 04/2014/TT-BLDTBXH guiding the implementation of policies on equipping personal protective equipment.
Principles for the use of personal protective equipment are detailed in Circular 04/2014/TT-BLDTBXH, specifically as follows:
- The employer must organize to guide employees to proficiently use appropriate personal protective equipment and must strictly inspect the usage.
- For specialized personal protective equipment with high technical requirements, the employer (or authorized person to distribute) must inspect to ensure quality and specifications before issuance, periodically inspect during use, and record in a logbook; do not use equipment that does not meet technical standards or is expired.
- Individuals equipped with personal protective equipment must use it appropriately while working. If the employees violates this, depending on the severity of the violation, they will be subject to disciplinary action according to their establishment's labor regulations or legal provisions.
- Employees are not required to pay for the use of personal protective equipment. The employer is responsible for re-equipping employees with personal protective equipment when lost, damaged, or expired. If lost or damaged without reasonable cause, the employees must compensate as per the establishment's labor regulations. Upon expiration or transfer to different jobs, the employees must return the personal protective equipment if so requested by the employer, but a handover must be signed.
