Decree on the Required Contents in the Dossier for Requesting Transitional Safeguard Measures

According to the provisions of Article 6 Circular 19/2019/TT-BCT, the dossier requesting the application of transitional safeguard measures includes an Application for the application of transitional safeguard measures and related documents and materials as stipulated in Article 47 of Decree 10/2018/ND-CP.

Specifically, the application for the application of transitional safeguard measures as specified in Clause 2, Article 47 of Decree 10/2018/ND-CP must meet the following additional specific contents:

- Description information about imported goods as specified at Point d, Clause 2, Article 47 of Decree 10/2018/ND-CP is information on imported goods from one or more member countries requested to be investigated for the application of transitional safeguard measures. In which, the information on commodity codes and import tariff rates must be based on the Export Tariff, Special Preferential Import Tariff to implement the Agreement.- Information on the volume, quantity, and value of imported goods under investigation as specified at Point e, Clause 2, Article 47 of Decree 10/2018/ND-CP during the 03 years preceding the submission of the Dossier request and must include at least 06 months after the Agreement takes effect;- Information on the volume, quantity, and value of similar goods or directly competitive goods of the domestic production sectors as stipulated at Point g, Clause 2, Article 47 of Decree 10/2018/ND-CP during the 03 years preceding the submission of the Dossier request and must include at least 06 months after the Agreement takes effect. In case the domestic production sector has operated for less than 03 years, the data collected will be the entire operating period of the domestic production sector until the time of dossier submission;- Information on the transitional period of imported goods required to be investigated, for the application of transitional safeguard measures.
