Decree 41: Working Relationship of Inspection Agencies in the People's Public Security Forces

Decree 41/2014/ND-CP stipulates the working relations of the inspection agency within the People's Public Security as follows:

- The Ministry Inspection Department is under the direction and management of the Minister of Public Security and under the direction and professional guidance of the Government Inspectorate of Vietnam.

- The inspection agencies within the People's Public Security, dedicated or concurrently assigned inspectors placed in locations without inspection organizations, operate under the direct management and direction of the Head of the same-level Public Security agency, meanwhile receiving professional direction and guidance from the immediate higher-level Public Security inspection agency.

- The relation between the inspection agencies within the People's Public Security and other competent agencies and units is a coordinating relation to perform the assigned tasks in accordance with the law and regulations of the Ministry of Public Security.

- The inspection agencies within the People's Public Security cooperate with the inspection bodies of other Ministries, sectors, and other relevant central and local agencies during the inspection process of issues related to the state management fields of the Ministry of Public Security and in the fight against legal violations.

Additionally, the Decree stipulates that the inspection activities within the People's Public Security must fully comply with the following principles:

- Comply with the Constitution and laws, discipline, and regulations of the Ministry of Public Security; ensure accuracy, objectivity, honesty, publicity, democracy, and promptness.- There should be no overlap in scope, subjects, and inspection contents between agencies exercising inspection functions; do not obstruct the normal operations of the agencies, organizations, and individuals subject to inspection.- When conducting inspections, the individual issuing the inspection decision, the Head of the Inspection agency, the Head of the inspection delegation, inspectors, and members of the inspection delegation must bear responsibility before the law for their actions and decisions.
