Decree 169/2016/ND-CP has been signed and promulgated by the Government of Vietnam regarding the handling of goods held by carriers at Vietnamese seaports.
According to Decree 169/2016/ND-CP, the customs procedures for imported and exported goods detained at ports in Vietnam are carried out as follows:
- For goods detained under Clause 1, Article 4 of Decree 169 that are auctioned by the carrier, customs procedures for importation must be completed. In addition to the customs dossier for imported goods, the carrier must submit the following documents to the customs authority:- A document requesting customs procedures for the importation of detained goods;- Proof relevant to the notification of detained goods in Vietnam (original copy).- For goods detained under Clauses 2 and 3, Article 4 of Decree 169, after the detention notification period, the carrier must carry out import procedures, notify abandonment, or re-export the goods within no more than 60 days from the date the ship arrives at the discharge port.
