1. Duties and powers of the Office of the Delegation of the National Assembly and the Provincial People's Council in Vietnam

According to Article 2 of Resolution 1004/2020/UBTVQH14, the duties and powers of the Office of the Delegation of the National Assembly and the Provincial People's Council in Vietnam are as follows:

- Regarding advisory, assisting, and serving the activities of the Delegation of the National Assembly, National Assembly delegates, the Office of the Delegation, and the Provincial People's Council has the following duties and powers:

+ Advise and assist the Head and Deputy Head of the Delegation of the National Assembly in the development and implementation of monthly, quarterly, semi-annual, and annual programs and plans of the National Assembly Delegation, convene meetings of the National Assembly Delegation, and maintain contact with the National Assembly delegates in the Delegation;

+ Coordinate with relevant agencies and organizations to facilitate National Assembly delegates meeting with voters; help the National Assembly Delegation aggregate voters' opinions and suggestions and forward them to competent authorities for consideration and resolution as per legal provisions;

+ Facilitate National Assembly delegates receiving citizens; receive, advise, and handle citizens’ complaints, denunciations, and recommendations submitted to the National Assembly Delegation and National Assembly delegates; monitor and urge the resolution of complaints, denunciations, and recommendations transferred by the National Assembly Delegation and delegates to competent authorities for resolution;

+ Advise and organize the Delegation of the National Assembly in legislative work, discussions, and provide opinions on matters upon request from the Standing Committee of the National Assembly;

+ Advise and assist in the oversight and survey activities of the National Assembly Delegation and delegates; execute directives from the Head and Deputy Head of the National Assembly Delegation to cooperate with relevant agencies and organizations to serve oversight and survey activities of the National Assembly, the Standing Committee of the National Assembly, the Ethnic Council, the Committees of the National Assembly, and agencies under the Standing Committee of the National Assembly at the local level;

+ Advise and assist the National Assembly Delegation in preparing reports on the situation of the activities of the National Assembly Delegation and delegates biannually, annually, or as required by the Standing Committee of the National Assembly;

+ Coordinate to serve the activities of the National Assembly Delegation and delegates during National Assembly sessions; assist National Assembly delegates in participating in the activities of the Ethnic Council, Committees of the National Assembly of which the delegate is a member and other activities of the National Assembly, the Standing Committee of the National Assembly, the Committees of the National Assembly, and agencies under the Standing Committee of the National Assembly;

+ Advise and assist the Deputy Head of the National Assembly Delegation in performing tasks as assigned by the Head of the National Assembly Delegation.

- Regarding advisory, assisting, and serving the activities of the People's Council, the Standing Committee of the People's Council, Committees of the People's Council, and People's Council delegates at the provincial level, the Office of the Delegation and Provincial People's Council has the following duties and powers:

+ Advise and assist the People's Council, the Standing Committee of the People's Council, and Committees of the Provincial People's Council in developing and implementing their work programs and activity plans monthly, quarterly, semi-annually, and annually;

+ Advise and assist the Standing Committee and Committees of the Provincial People's Council in constructing programs, organizing service for People's Council sessions, Standing Committee meetings, and committee meetings; coordinate with relevant agencies and organizations to prepare documents for People's Council sessions, Standing Committee meetings, and committee meetings; advise and assist Committees in the Provincial People's Council in verifying draft resolutions, projects, reports, and completing draft resolutions, projects, and reports of the Provincial People's Council;

+ Advise and assist the People's Council, the Standing Committee, Committees, delegate groups, and delegates in oversight and survey activities; compile delegate questions; monitor, compile, and urge agencies, organizations, and individuals to implement resolutions on oversight and questioning;

+ Coordinate with relevant agencies and organizations to serve Provincial People's Council delegates in meeting with voters; help the Standing Committee of the Provincial People's Council compile voters' opinions and suggestions and forward them to competent authorities for consideration and resolution as per legal provisions;

+ Serve the Standing Committee and delegates in receiving citizens; receive, advise, and handle citizens' complaints, denunciations, and recommendations submitted to the People's Council and the Standing Committee of the Provincial People's Council; monitor and urge the resolution of complaints, denunciations, and recommendations transferred by the People's Council, the Standing Committee, and delegates to competent authorities for resolution;

+ Advise and assist the Standing Committee of the Provincial People's Council in proposing the structure, composition, and number of delegates of the upcoming People's Council elections; approve the election results, dismiss or remove the Chairman and Vice Chairman of district-level People’s Councils; address issues between sessions of the People's Council; maintain contact with Committees, delegate groups, and delegates of the Provincial People's Council;

+ Advise and assist the Standing Committee of the Provincial People's Council in organizing briefings, exchanging experiences, and training activities for People's Council delegates at all levels; draft reports for submission to competent authorities;

+ Serve the Standing Committee, Chairman, and Vice Chairman of the Provincial People's Council in directing general work; coordinate activities of the Committees of the Provincial People's Council; ensure adherence to operational regulations of the People's Council, the Standing Committee, and committees, and session rules; serve in the foreign affairs activities of the People's Council, the Standing Committee, Committees, and provincial delegates.

- In administrative, organizational, and management tasks, the Office of the Delegation and the Provincial People's Council has the following duties and powers:

+ Serve the Delegation, Head, and Deputy Head of the Delegation of the National Assembly, the People's Council, the Standing Committee, and Committees of the Provincial People's Council in maintaining contact with central and other provincial government bodies, the Standing Committee of the Provincial Party Committee, City Party Committee, People's Committee, Vietnam Fatherland Front Committee, People's Court, People's Procuracy at the same level, and other local organizations and associations;

+ Prepare the state budget estimates for the operation of the Provincial Delegation and People's Council based on consultations with the Head of the Delegation, the Standing Committee of the Provincial People's Council; manage financial allocations for the operation of the Delegation and the People's Council;

+ Ensure conditions for the operation of the National Assembly Delegation, National Assembly delegates, the People's Council, the Standing Committee, Committees, delegate groups, and delegates of the Provincial People's Council; advise on implementing policies for National Assembly delegates and Provincial People's Council delegates;

+ Manage physical facilities, public assets, administrative work, security, and protocol of the Delegation and People's Council;

+ Participate in planning, training, professional development, and management of officials in the Office according to legal regulations;

+ Conduct scientific research; develop and utilize information and data systems for the Delegation and People's Council; apply information technology in Office operations;

+ Perform other tasks assigned by the Head, Deputy Head of the Delegation, Chairman, Vice Chairman of the People's Council, the Standing Committee, and Committees of the Provincial People's Council;

+ Perform duties and powers according to other relevant legal provisions.

2. Organizational structure of the Office of the Delegation of the National Assembly and the Provincial People's Council in Vietnam

The organizational structure of the Office of the Delegation of the National Assembly and the Provincial People's Council in Vietnam as per Article 3 of Resolution 1004/2020/UBTVQH14 is as follows:

- The Office has a Chief of Office and no more than 03 Deputy Chiefs of Office.

The Standing Committee of the Provincial People's Council, after reaching an agreement with the Head and Deputy Head of the National Assembly Delegation, decides on the appointment and dismissal of the Chief of Office and Deputy Chiefs of Office; evaluates the officials of the Chief of Office.

- The Office is organized into departments including:

+ Department of National Assembly Affairs;

+ Department of People's Council Affairs;

+ Department of Administration, Organization, and Management;

+ Based on the actual situation, the Standing Committee of the Provincial People's Council, after reaching an agreement with the Head and Deputy Head of the National Assembly Delegation, may decide to establish an additional department to handle an area of work that is relatively independent within the functions and responsibilities of the Office.

- The Chief of the Office stipulates specific duties and powers of the departments in the Office after consulting with the Head, Deputy Head of the National Assembly Delegation, and the Standing Committee of the Provincial People's Council.

- Departments may have a Head and Deputy Heads, with the number of Deputy Heads specified as follows:

+ Departments in the Offices of the Delegation and People's Council of Hanoi and Ho Chi Minh City with less than 10 staffing positions, departments in type I provincial-level Offices with less than 09 staffing positions, departments in type II and III provincial-level Offices with less than 08 staffing positions are allocated 01 Deputy Head;

+ Departments in the Offices of the Delegation and People's Council of Hanoi and Ho Chi Minh City with 10 to 14 staffing positions, departments in type I provincial-level Offices with 09 to 14 staffing positions, departments in type II and III provincial-level Offices with 08 to 14 staffing positions are allocated no more than 02 Deputy Heads;

+ Departments in the Offices of Provincial People's Councils with 15 staffing positions or more are allocated no more than 03 Deputy Heads.

- The Chief of the Office decides on the appointment and dismissal of Heads and Deputy Heads of departments after consulting with the Head, Deputy Head of the Delegation, and the Standing Committee of the Provincial People's Council.

- The staffing of the Office is within the total administrative staffing of the locality, determined by the Provincial People's Council.

The staffing of full-time National Assembly delegates in the Delegation and full-time Provincial People's Council delegates is not part of the staffing of the Office of the Delegation and the Provincial People's Council but belongs to the staffing of leadership of elected bodies in the locality, within the total number of officials of the province or central-affiliated city.
