On June 30, 2020, the Ministry of Industry and Trade issued Circular 14/2020/TT-BCT guiding certain regulations on specialized inspection in the industry and trade sector, effective from August 15, 2020.
Circular 14: New regulations on the tasks and authority of the advisory department (illustration)
Circular 14/2020/TT-BCT stipulates the tasks and authority of the advisory department regarding specialized inspection work at the General Department of Market Management and equivalent, Departments under the Ministry of Industry and Trade, Departments under the General Department of Market Management, as detailed below:
- Advise and assist the General Director and equivalent, Department Directors under the Ministry of Industry and Trade, and Department Directors under the General Department of Market Management (hereinafter collectively referred to as heads of the agencies) in performing tasks and authority as prescribed in Decree 127/2015/ND-CP;- Based on the function, tasks, and authority, advise and assist the heads of the agencies in formulating the annual inspection plan, act as the focal point to cooperate with the Inspectorate of the Ministry of Industry and Trade in constructing and adjusting the annual inspection plan according to the state management requirements of the Ministry, the agencies, and the actual situation;- Advise and assist the heads of the agencies in organizing the implementation of the inspection plan approved by the Minister of Industry and Trade;- Assist the heads of the agencies in monitoring, urging, and inspecting the implementation of inspection conclusions, recommendations, post-inspection handling decisions, complaint resolution decisions, complaint content conclusions; advise on the resolution of complaints arising during the implementation of specialized inspection tasks, recommend handling administrative violations in accordance with the law;- Advise and assist the heads of the agencies in implementing information policies and reporting related to specialized inspection work;- Request agencies to appoint members to participate in the specialized inspection team;- Handle within their authority or recommend the competent state agencies to handle violations of the law discovered through the inspection work.
