Circular 116/2017/TT-BTC was issued on October 25, 2017. One of the basic provisions stipulated in this document is the regulation of the obligations of the Stock Exchange and the Vietnam Securities Depository.
To be specific, according to the guidance in Circular 116/2017/TT-BTC, the Stock Exchange and the Vietnam Securities Depository Center have the following obligations:
First, issue regulations, procedures, and operational documents in accordance with securities laws and the securities market.
Second, implement reporting policies as stipulated in Chapter IV of this Circular.
Third, perform storage and confidentiality measures for records, documents, vouchers, and operational data according to legal regulations.
Fourth, fully, accurately, and promptly provide information, documents, and data as requested by the SSC to serve compliance monitoring.
Fifth, the Stock Exchange supervises compliance with securities laws and market regulations and its own regulations for trading members, special trading members, listed and registered trading organizations, and individuals participating in the securities market.
The Securities Depository Center supervises compliance with securities laws and market regulations and its own regulations for depository members and clearing members. If violations are detected, the Stock Exchange and the Securities Depository Center are responsible for handling them according to their regulations. In cases beyond their authority, they must report to the SSC for handling in accordance with legal regulations.
Sixth, undergo inspection and supervision by the SSC according to securities laws and market regulations stipulated in this Circular; report explanations and remediation plans for the conclusions and recommendations of the SSC regarding compliance monitoring results.
Seventh, propose and recommend to the SSC the issuance, amendment, and supplementation of legal regulations and operational documents of the Stock Exchange and the Securities Depository Center as appropriate.
Circular 116/2017/TT-BTC is effective as of December 8, 2017.
