Cases in which Communist Party Members Having a Third Child are Not Subject to Disciplinary Action

According to Regulation 102/QD-TW on the disciplinary handling of Communist Party members, having a third child or more is considered a violation of population and family planning policies and is subject to disciplinary action. However, Communist Party members will not be subject to disciplinary action if having a third child or more falls under one of the following cases:

- Couples having a third child, if both or one of the parties belong to an ethnic group with a population of less than 10,000 people or an ethnic group at risk of population decline (birth rate equal to or less than the death rate) as officially announced by the Ministry of Planning and Investment;

- Couples having a first birth that results in triplets or more;

- Couples who already have one biological child, having a second birth that results in two or more children;

- Couples having a third birth or more, if at the time of birth they have only one living biological child, including biological children who have been given up for adoption;

- Couples having a third child, if they already have two biological children but one or both of the children have a defect or suffer from a serious non-hereditary illness, as confirmed by the Provincial or Central-level Medical Examination Council;

- Couples who already have biological stepchildren:

- Having one or two children, if one of the parties has biological stepchildren;- Having one or more children in the same birth, if both parties have biological stepchildren. This provision does not apply if both parties have previously had two or more mutual children who are currently alive.

- Unmarried women who give birth to one or more children in the same birth;

- Having a third child or more before January 19, 1989.
