All Citizens with Voting Rights Must be Included in the Voter List

According to the provisions of the law, every citizen with the right to vote shall be registered in the voter list and issued a voter card, except for cases where individuals are not to be registered in the voter list. So, what are the legal regulations regarding the compilation of the voter list?

According to the provisions of Article 29 of the Law on Election of Deputies to the National Assembly and Deputies to the People's Councils 2015, the compilation of the voter list is carried out following these principles:

- Every citizen with the right to vote shall be listed in the voter list and issued a voter card, except for the cases specified in Clause 1, Article 30 of the Law on Election of Deputies to the National Assembly and People's Councils 2015;

- Each citizen shall only be listed in one voter list at their place of permanent or temporary residence;

- Voters who are temporarily residing and have registered their temporary residence in the locality for less than 12 months, and voters who are soldiers in people's armed units shall be listed in the voter list to elect Deputies to the National Assembly, the provincial and district People's Councils at their temporary residence or military unit;

- Vietnamese citizens residing abroad returning to Vietnam within the period from after the voter list has been posted until 24 hours before the start of voting, must present their passport with Vietnamese nationality at the commune People's Committee to be listed in the voter list and receive a voter card to elect Deputies to the National Assembly and the provincial, district, and commune-level People's Councils (if presented at the place of permanent residence) or to elect Deputies to the National Assembly and the provincial and district-level People's Councils (if presented at the place of temporary residence);

- Voters who are being detained, held in custody, or undergoing compulsory education at compulsory education centers or compulsory detoxification centers shall be listed in the voter list to elect Deputies to the National Assembly and the provincial People's Councils at the place where they are detained, held in custody, or undergoing compulsory education or detoxification.

Additionally, the law also specifies cases where names are not listed, deleted, or added to the voter list. To be specific:

- Persons deprived of voting rights by a legally effective court judgment or decision, persons sentenced to death pending execution, those serving prison sentences without parole, or persons who have lost their civil act capacity shall not be listed in the voter list;

- Persons specified in Clause 1, Article 30 of the Law on Election of Deputies to the National Assembly and People's Councils 2015, if 24 hours before the start of voting have their voting rights restored, are released, or are confirmed by the competent authority as no longer in the state of losing civil act capacity, shall be added to the voter list and issued voter cards as provided in Article 29 of the Law on Election of Deputies to the National Assembly and People's Councils 2015;

- From the time after the voter list has been posted until 24 hours before the start of voting, those who change their place of permanent residence outside the commune-level administrative unit where they were listed in the voter list shall be deleted from the voter list at the old residence and added to the voter list at the new place of permanent residence to elect Deputies to the National Assembly, the provincial, district, and commune-level People's Councils; those who move to temporary residences in places different from the commune-level administrative unit where they were listed and wish to vote at the new temporary residence shall be deleted from the voter list at the old residence and added to the voter list at the new temporary residence to elect Deputies to the National Assembly, the provincial and district People's Councils;

- Voters specified in Clause 5, Article 29 of the Law on Election of Deputies to the National Assembly and People's Councils 2015, if 24 hours before the start of voting are released or have completed compulsory education or detoxification, shall be deleted from the voter list at the place where the detention center, compulsory education center, or compulsory detoxification center is located and added to the voter list at the place of permanent registration to elect Deputies to the National Assembly and the provincial, district, and commune-level People's Councils, or added to the voter list at the temporary registration place to elect Deputies to the National Assembly and the provincial and district-level People's Councils;

- Persons already listed in the voter list but later deprived of voting rights by a court, sentenced to prison, or losing their civil act capacity shall have their name deleted from the voter list and their voter card revoked by the commune People's Committee.

This content is specified in Article 30 of the Law on Election of Deputies to the National Assembly and Deputies to the People's Councils 2015.
