6 Conditions for Meeting the C/O Issued by the Exporting Member Organization

Recently, the Ministry of Industry and Trade issued Circular 40/2015/TT-BCT implementing the Rules of Origin under the Vietnam - Korea Free Trade Agreement.

Appendix IV regarding the issuance and verification process of origin, promulgated together with Circular 40/2015/TT-BCT, stipulates that the C/O issued by the C/O Issuing Organization of the exporting member shall be based on the application of the manufacturer or exporter or the authorized person. The C/O must meet the following 06 conditions:

  1. Made on A4-sized paper, in accordance with the sample provided in clause 1 of this Article. In case the product descriptions cannot be all listed on one C/O sheet, member countries may use the C/O Supplementary Declaration Form in accordance with the sample provided in Appendix VII of this Circular;
  2. Includes 1 (one) original copy and 2 (two) duplicate copies. The original (the original) is sent by the manufacturer or exporter to the importer for submission to the customs authority of the importing member country. The second copy (the duplicate) is kept by the C/O Issuing Organization of the exporting member country. The third copy (the triplicate) is kept by the manufacturer or exporter;
  3. Filled out in English and one or more products can be declared in one shipment;
  4. Hand-printed, signed and sealed or electronically printed, signed and sealed;
  5. Includes information on the description of goods, quantity, and weight consistent with the exported shipment; and
  6. Contains a unique reference number of the C/O Issuing Organization.

Notes: The C/O can be issued before or at the time of shipment, or within 3 working days from the date of shipment. In exceptional cases where the C/O is not issued before or at the time of shipment, or within 3 working days from the date of shipment due to an unintentional error or valid reason, the C/O can be issued later but not exceeding 1 year from the date of shipment and must bear the statement “ISSUED RETROACTIVELY.”
