13 Prohibited Acts in Fishery Activities

Law on Fisheries 2017 passed by the 14th National Assembly, at its 4th session on November 21, 2017, prescribes prohibited acts in fisheries activities, including:

  1. Destroying aquatic resources, aquatic ecosystems, spawning areas, nursing areas for juvenile aquatic species, habitats of aquatic species.
  2. Illegally obstructing the natural migration routes of aquatic species.
  3. Encroaching, occupying, or damaging areas that protect aquatic resources, marine protected areas.
  4. Exploiting, farming aquatic products, constructing buildings, and other activities that impact the environment, aquatic resources in the strictly protected and ecological recovery zones of marine protected areas.
  5. Unauthorized operation of fishing vessels, marine vessels, and other watercraft within the strictly protected zones of marine protected areas, except in cases of force majeure.
  6. Illegal, unreported, unregulated (IUU) fishing (hereinafter referred to as illegal fishing); buying, selling, transporting, storing, preliminarily processing, processing aquatic products from illegal fishing, aquatic products with impurities for commercial fraud purposes.
  7. Using banned substances, chemicals, toxins, explosives, electric pulses, electric currents, destructive methods, equipment, and fishing gear to exploit aquatic resources.
  8. Using fishing gear that obstructs or causes harm to organizations or individuals currently fishing; anchoring or docking at locations with fishing gear of organizations or individuals currently fishing or where other fishing vessels are operating, except in cases of force majeure.
  9. Disposing of fishing gear into natural water bodies, except in cases of force majeure.
  10. Introducing impurities into aquatic products for commercial fraud purposes.
  11. Using antibiotics, veterinary drugs, and plant protection substances banned in aquaculture; using banned chemicals, biological products, microorganisms in the production of aqua feed, and environmental treatment products in aquaculture; using aquatic breeds not listed in the permitted aquatic species in Vietnam for aquaculture.
  12. Destroying, dismantling, causing damage, occupying the premises of fishing ports, storm shelters for fishing vessels; discharging waste improperly within fishing port areas, storm shelters for fishing vessels.
  13. Exploiting fishery resource assessment investigations that affect national defense, security, national interests, lawful rights, and interests of organizations and individuals; providing, extracting information, or using information and data about fishery resources contrary to legal regulations.

Fisheries Law 2017 came into effect on January 1, 2019.
