Tasks and Powers of the Department of Justice in Managing Notary Practice Apprenticeship (Illustration)
Circular 04/2015/TT-BTP stipulates that in managing notary practice apprenticeship, the Department of Justice has the following responsibilities and powers:
1. Designate qualified notary practice organizations within the locality to accept Apprentices; review the refusal to accept apprentices by notary practice organizations in accordance with this Circular.
2. Register apprenticeships, and decide on the termination of apprenticeships in accordance with this Circular.
3. Establish and publish the List of Apprentices of the Department of Justice, and the List of qualified notary practice organizations within the locality on the Department of Justice's electronic portal; regularly review and update these lists; send the List of Apprentices of the Department of Justice to the Ministry of Justice to compile a national List of Apprentices; send the List of Apprentices of the Department of Justice to the Notary Association (where established); keep a Record of notary practice apprenticeships (Form TP-TSCC-03).
4. Examine the implementation of rights and obligations of notary practice organizations, guiding notaries, and Apprentices in accordance with this Circular.
5. Prepare the list of individuals eligible to register for the notary practice apprenticeship examination and send proposals to the Ministry of Justice as stipulated by this Circular.
6. Review and propose the Minister of Justice to appoint notaries for Apprentices in the locality who have passed the notary practice apprenticeship examination after receiving written comments from the Notary Association (where established).
7. Inspect, investigate, handle violations, and resolve complaints and denunciations related to notary practice apprenticeships in accordance with the law.
8. Perform other tasks and powers as prescribed by the Law on Notarization, this Circular, and other relevant legal documents.
