Regarding this issue, LawNet would like to answer as follows:
On November 14, 2023, the Minister of Culture, Sports, and Tourism issued Circular 14/2023/TT-BVHTTDL regulating emulation and reward work in the Culture, Sports, and Tourism industry.
Medal "For the Cause of Culture, Sports, and Tourism" (hereinafter referred to as Medal) is a form of reward given by the Minister to recognize and encourage individuals who have contributed greatly to the construction and development of the Industry.
Commemorative medals can only be awarded once.
(Clause 1, Article 9 of Circular 14/2023/TT-BVHTTDL)
According to Clause 2, Article 9 of Circular 14/2023/TT-BVHTTDL, the following subjects are considered to be awarded the Medal "For the Cause of Culture, Sports, and Tourism":
(1) Individuals working in the industry at agencies and units under the Ministry; Department of Culture, Sports, and Tourism; Department of Culture and Sports; Department of Tourism of provinces and centrally run cities;
(2) Individuals outside the industry who have made many contributions to the cause of building and developing culture, sports and tourism;
(3) Individuals who are Vietnamese residing abroad and foreigners who have made positive contributions to the construction and development of culture, sports, and tourism in Vietnam;
(4) Individuals who voluntarily quit their job, are disciplined and forced to quit their job, or are convicted by a legally effective court judgment or decision are not considered for awarding a Medal;
(5) Individuals while the competent authority is considering disciplinary action, investigation, inspection, or examination
When there are signs of violation, complaints, or denunciations being verified and clarified, the medal has not been considered;
(6) Individuals who have enough working time as prescribed but are disciplined below the level of dismissal will only be considered for awarding a Medal after 02 years from the time the discipline is removed. Disciplinary time is not counted for consideration in awarding a Medal.
Specifically, Article 10 of Circular 14/2023/TT-BVHTTDL stipulates the criteria for awarding the Medal "For the Cause of Culture, Sports and Tourism" as follows:
(i) Individuals who have been working in the industry will be considered for the Medal when they have 20 years or more of work for men and 15 years of work or more for women (including time spent studying or performing military service).
(ii) Individuals specified in (i) will be considered for awarding the Medal earlier than prescribed in one of the following cases:
- For individuals who have worked in extremely difficult areas, border areas, or islands, the actual working time in the above areas is multiplied by a factor of 1.3 to calculate the working time in the Industry;
- Dancers, circus performers, and national sports team athletes are considered for awarding medals 5 years earlier than prescribed;
- Individuals awarded the titles of Labor Hero, National Emulation Soldier, People's Artist, Meritorious Artist, People's Artisan, Meritorious Artisan, People's Teacher, Meritorious Teacher, People's Physicians, Meritorious Physicians, and authors whose works or clusters of works have been awarded the Ho Chi Minh Prize and the State Prize for literature and art are recommended for consideration. Commemorate the medal immediately after the decision to award this title or award is made.
(iii) Individuals working outside the Industry will be considered for a Medal when they meet one of the following criteria:
- Hold a management position (allowance coefficient 0.7 or higher) for 5 years and make many contributions in leadership, direction, and contribution to the development of the Industry;
- Lead or participate in state-level scientific research projects in the fields of culture, family, physical education, sports, and tourism, accept and receive a grade of pass or higher; be applied effectively; and have practical value to serve the cause of the Industry;
- Make a positive contribution to the protection and promotion of tangible, intangible cultural heritage and documentary heritage, or make a major contribution in terms of facilities, financial support, and service to the cause of the Industry.
(iv) Individuals who are Vietnamese residing abroad and foreigners who have made positive contributions to the construction and development of culture, sports, and tourism in Vietnam.
(v) Other cases decided by the Minister
Circular 14/2023/TT-BVHTTDL takes effect on January 1, 2024
