04 Enforcement Costs Borne by the Judgment Creditor

This is an important content stipulated in Circular 200/2016/TT-BTC regulating the preparation, management, use, and settlement of funds ensuring the operation of civil judgment enforcement agencies, and enforcement fees.

According to Circular 200/2016/TT-BTC, when enforcing civil judgments, the judgment creditor must bear the following costs:

- Revaluation costs of assets as prescribed in point a, clause 3, Article 4 of Circular 200/2016/TT-BTC if the judgment creditor requests revaluation, except in cases where revaluation is carried out due to violations of valuation regulations.- A part or the full cost of construction and demolition in cases where the judgment or decision determines the judgment creditor must bear the cost of construction and demolition.- Costs of inventory and handling of assets as prescribed in clause 4, Article 17 of Decree 62/2015/ND-CP, corresponding to the proportion of the amount or assets they actually receive.- In cases where the judgment creditor requests the enforcement agency to apply improper measures to secure the enforcement of the judgment, that person must pay the actual costs incurred due to the enforcement of the decision to apply such measures.
