03 Responsibilities of the Provincial People's Committee Where the Planting Forests Do Not Become Forests and Are Liquidated

On February 20, 2013, the Ministry of Finance signed and promulgated Circular 18/2013/TT-BTC providing guidance on the procedures for liquidation of planted forests and the management and use of proceeds from the liquidation of planted forests that have not become forests and planted forests that are incapable of becoming forests.

According to the provisions in Article 8 of Circular 18/2013/TT-BTC, the Provincial People's Committee where planted forests fail to turn into natural forests, or planted forests that are unable to become natural forests are to be liquidated, has the following responsibilities:

- Direct financial, agricultural, and rural development agencies, other relevant agencies within the management scope, the project owner of afforestation, the District People's Committee where the planted forests are to be liquidated, and other involved agencies, organizations, and individuals to implement the liquidation of planted forests that fail to turn into natural forests as guided by this Circular.- Manage and handle afforestation land and post-liquidation land as per land law regulations.- Inspect and handle within their authority cases of violations or complaints and denunciations related to forest liquidation.

Additionally, Circular 18 also stipulates responsibilities for the Ministry, central agencies assigned by the state to afforest as follows:

- Direct relevant agencies within the management scope, organizations assigned as project owners of afforestation to cooperate with local functional agencies where the planted forests are to be liquidated to implement the liquidation of planted forests that fail to turn into natural forests as guided by this Circular.- Inspect and handle within their authority cases of violations or complaints and denunciations related to forest liquidation.

The Ministries, central agencies, and Provincial People's Committees assigned to organize afforestation with funds specified in Clause 1, Article 1 of this Circular, if forest liquidation arises, must report the implementation status of forest liquidation to the Ministry of Agriculture and Rural Development, the Ministry of Finance before March 31 each year. The Ministry of Agriculture and Rural Development will lead the consolidation of reports on the status of forest liquidation and submit to the Prime Minister of the Government of Vietnam before April 30 each year.
