Vietnam’s Circular No. 16/2020/TT-BQP: Extending the temporary suspension of military service

This is a notable content of the Circular No. 16/2020/TT-BQP stipulating the application of disciplinary forms, order, procedures, statute of limitations, time limit and disciplinary handling competence in the Ministry of National Defense of Vietnam.

Specifically, according to Clause 1 Article 8 of the Circular No. 16/2020/TT-BQP of the Ministry of National Defense of Vietnam:

In case the disciplinary violator, if continuing to work may affect the completion of the unit's tasks or cause difficulties for verification, during the period of consideration and disciplinary action, the regimental commanders, political commissars of regimens and equivalent or higher are entitled to temporarily suspend work for discipline violators under their management and temporarily appoint a replacement, but must report to superiors.

The time limit for temporary suspension of work for disciplinary violators is prescribed as follows:

- The duration of temporary suspension from work does not exceed 03 (three) months (according to previous provision of Circular No. 192/2016/TT-BQP, the duration of temporary suspension from work does not exceed 30 days)

- In special cases due to many complicated circumstances that need to be clarified, it may be extended but must not exceed 05 (five) months. (according to previous provision, the duration of temporary suspension from work does not exceed 3 months)

Thus, in comparison with previous regulations, the period of temporary suspension of work for those who violate discipline in national defense will last from 01 month to 03 months. Special cases last from 03 months to 05 months. This new temporary work suspension period shall be applied from April 08, 2020.

Moreover, Circular No. 16/2020/TT-BQP of the Ministry of National Defense of Vietnam also stipulates that soldiers, officials, workers and national defense officers who are sent for training with the State budget must compensate for training expenses in the following cases:

- Voluntarily dropping out of school;

- Violates discipline to the point of not being able to continue training;

- Graduated but did not accept the assignment or quit the job without enough working time up to 05 years for those who have been trained for less than 05 years and up to 05 years for those who have been trained for 05 years or more since graduation.
