The Law amending and supplementing a number of articles of the Law on Officials and the Law on Public Employees was passed by the National Assembly at the 8th session of the 14th National Assembly on November 25, 2019, and will officially take effect from July 1, 2020.

Amended Law on Officials and Amended Law on Public Employees
This Law has amended and supplemented regulations regarding the evaluation and classification of officials and public employees as previously defined in the Law on Officials and the Law on Public Employees. To be specific:
Regarding evaluation content:
For officials, in addition to the current evaluation criteria, from July 1, 2020, officials will also be evaluated based on the following contents:
- Compliance with regulations of the agency, organization, or unit;- Progress and quality of task performance. The evaluation of task performance results must be linked to the job position, manifested through specific work and products.
Simultaneously, this Law also stipulates that the evaluation regarding the service attitude toward people and businesses will only apply to positions that directly interact with citizens and businesses.
For public employees, aside from the current evaluation criteria, from July 1, 2020, public employees will also be evaluated based on the results of task execution or planned tasks, or specific assigned tasks; progress and quality of task performance. The evaluation of task performance results must be linked to the job position, manifested through specific work and products.
It can be seen that the Amended and Supplemented Law on the Law on Officials and the Law on Public Employees emphasizes that from July 1, 2020, the evaluation and classification of officials and public employees will be linked to job positions and reflected through specific work and products. This is one of the important changes in this Law, marking a beginning step in implementing salary payment based on job positions for officials and public employees.
Regarding evaluation timing:
For officials, from July 1, 2020, the evaluation and classification timing includes: annual evaluation, evaluation before the promotion exam, advancement in salary grade before the deadline, appointment, re-appointment, planning, transfer; evaluation before the end of rotation or secondment period. (Currently, the evaluation and classification of officials are conducted annually, before appointment, planning, transfer, training, re-training, at the end of the rotation or secondment period.)
For public employees, from July 1, 2020, the evaluation and classification timing include: annual evaluation; evaluation before the end of the probation period, re-signing of work contracts, change of job position; evaluation before reward, discipline, appointment, re-appointment, planning. (Under current regulations, the evaluation and classification of public employees are also conducted when training, re-training public employees.)
Additionally, depending on the management requirements of the agency, organization, or unit, the head of the agency with competent authority to manage officials and public employees may stipulate the evaluation of officials and public employees on a quarterly, monthly, or weekly basis, suitable to the specific work characteristics of the agency, organization, or unit, ensuring transparency, democracy, objectivity, and quantification through specific results and products. This evaluation result serves as the basis for annual evaluation and classification of officials and public employees, as well as before the promotion exam, advancement in salary grade before the deadline, appointment, re-appointment, planning, transfer; before the end of the rotation or secondment period for officials; before the end of the probation period, re-signing of work contracts, change of job positions; evaluation before reward, discipline, appointment, re-appointment, planning for public employees. (This is a newly added content in the Amended and Supplemented Law on the Law on Officials and the Law on Public Employees compared to current regulations.)
