The Government of Vietnam has issued Decree 146/2018/ND-CP detailing and guiding the implementation measures for several articles of the Law on Health Insurance. Several regulations related to health insurance for officials and public employees are guided for implementation as follows:
Public officials and employees contribute to health insurance by 4.5% based on the monthly salary. The salary used to calculate health insurance contributions is the monthly salary according to grade, rank, and allowances for position, seniority exceeding the frame, and occupational seniority (if any), and is based on the following formula:
Health Insurance Contribution Amount = (Salary + allowances calculated based on statutory pay rate of 1,390,000 VND/month) x 4.5%
Note:
- Pursuant to Point d Clause 1 Article 22 of the Health Insurance Law 2008, officials and public employees are entitled to 80% of medical examination and treatment costs;
- Additionally, in Point a Clause 1 Article 7 of Decree 146/2018/ND-CP, it is stipulated that employees who are on sick leave for 14 days or more within a month, in accordance with the provisions of the law on social insurance, are not required to pay health insurance but are still entitled to health insurance benefits;
- Employees who are temporarily detained, held, or suspended from work for investigation and review to determine if they have violated the law will have a monthly contribution rate of 4.5% based on 50% of their monthly salary. If the competent authority concludes that there is no violation of the law, the employee must retroactively pay health insurance on the retroactively received salary;
