To be specific, in Article 3 of Decree 13/2012/ND-CP issued on March 2, 2012, on Regulations of Initiatives, it states:

An initiative is a technical solution, management solution, operational solution, or a solution for applying technical advancements (collectively referred to as solutions), which is recognized by the agency if it meets all the following conditions:

a) It is new within the scope of the agency;

b) It has been applied or experimentally applied at the agency and has the potential to bring practical benefits;

c) It does not fall under the exclusion subjects stipulated in Clause 2 of this Article.

In Articles 11, 18, 25 of Decree 56/2015/ND-CP, the criteria for evaluating and classifying officials and public employees at the level of excellent task performance are stipulated as follows:

- For officials, when classified for evaluation at the level of excellent task performance, it is required to have specific initiatives or solutions applied to enhance the efficiency and effectiveness of the activities of agencies, organizations, or the sector/field of responsibility and recognized by competent authorities.

- For officials, when classified for evaluation at the level of excellent task performance, it is required to have at least one scientific project, scheme, topic, or initiative effectively applied in public administration activities of the agency, organization, or unit and recognized by competent authorities.

- For public employees, when classified for evaluation at the level of excellent task performance, it is required to have at least one scientific project, scheme, topic, or initiative applied and bringing effective results in specialized or professional activities and recognized by competent authorities.

However, Decree 90/2020/ND-CP, upon issuance, abolished the criteria for initiatives. Thus, criteria for evaluating and classifying officials and public employees at the level of excellent task performance are specified as follows:

  1. Criteria for evaluating the quality of officials at the level of excellent task performance

An official who meets all the following criteria will be classified at the level of excellent task performance quality:

- Comply well with the regulations in Clause 1, Clause 2, Clause 3, Clause 4, and Point a Clause 5 of Article 3 of this Decree.- The criteria for task performance results according to legal provisions, the set plan, or specific assigned tasks are met on time, with high quality and efficiency.- Lead, direct, and manage agencies, organizations, units, or assigned sectors/fields to fulfill all targets and tasks, of which at least 50% exceed the targets.- Ensure 100% of agencies, organizations, units under direct management are evaluated as meeting the tasks, of which at least 70% complete tasks well or excellently.

  1. Criteria for evaluating the quality of officials at the level of excellent task performance

- Officials not holding leadership or management positions who meet all the criteria below will be classified at the level of excellent task performance quality:

- Comply well with the regulations in Clause 1, Clause 2, Clause 3, and Clause 4 of Article 3 of this Decree;- Fulfill 100% of tasks according to legal regulations, the set plan, or specifically assigned tasks, ensuring timely, high-quality, and efficient completion, with at least 50% of tasks exceeding targets.

- Officials holding leadership or management positions who meet all the following criteria will be classified at the level of excellent task performance quality:

- Comply well with the regulations in Clause 1, Clause 2, Clause 3, Clause 4, and Point a Clause 5 of Article 3 of this Decree;- The criteria for task performance results according to legal provisions, the set plan, or specific assigned tasks are met on time, with high quality and efficiency;- Lead, direct, and manage agencies, organizations, units, or assigned sectors/fields to fulfill all targets and tasks, of which at least 50% exceed the targets;- Ensure 100% of units under direct management are evaluated as meeting the tasks, of which at least 70% complete tasks well or excellently.

  1. Criteria for evaluating the quality of public employees at the level of excellent task performance

- Public employees not holding management positions who meet all the criteria below will be classified at the level of excellent task performance quality:

- Comply well with the regulations in Clause 1, Clause 2, Clause 3, and Clause 4 of Article 3 of this Decree;- Fulfill 100% of tasks according to the signed working contract, the set plan, or specifically assigned tasks, ensuring timely, high-quality, and efficient completion, with at least 50% of tasks exceeding targets.

- Public employees holding management positions who meet all the following criteria will be classified at the level of excellent task performance quality:

- Comply well with the regulations in Clause 1, Clause 2, Clause 3, Clause 4, and Point a Clause 5 of Article 3 of this Decree;- The criteria for task performance results according to the signed working contract, the set plan, or specifically assigned tasks are met on time, with high quality and efficiency;- Ensure the unit or sector of responsibility fulfills all targets and tasks, of which at least 50% exceed the targets;- Ensure 100% of units under direct management are evaluated as meeting the tasks, of which at least 70% complete tasks well or excellently.

It can be seen that Decree 90/2020/ND-CP has reduced the criteria, easing the evaluation and classification process for officials and public employees, and it also aims to eliminate issues such as formality, coping, and copying experience initiatives.
