On August 13, 2020, the Government of Vietnam issued Decree 90/2020/ND-CP on evaluation and classification of the quality of officials and public employees, replacing Decree 56/2015/ND-CP, officially effective from August 20, 2020.

From 2020, the assessment and classification of officials and public employees will follow new regulations specified in Decree 90/2020/ND-CP with the following specifics:
1. Time for the Assessment and Classification of Officials and Public Employees in Vietnam
Previously, according to Clause 2, Article 5 of Decree 56/2015/ND-CP, the assessment and classification of officials and public employees were conducted in December each year. However, from 2020, Decree 90/2020/ND-CP stipulates as follows:
2. The timing for assessing and classifying the quality of officials and public employees will be conducted before December 15 each year, prior to the quality assessment and classification of party members and the annual review of commendation and emulation in the agency, organization, unit.
For public service providers operating in the field of education and training, or other fields that end their fiscal year before December each year, the head of the public service provider will decide the timing for assessing and classifying the quality of public employees.
Thus, the time for the assessment and classification of officials and public employees in 2020 has changed.It will be conducted before December 15 instead of throughout December as before.
2. Criteria for Classifying the Quality of Officials and Public Employees in Vietnam
Besides the new regulation on timing, the assessment of officials and public employees from 2020 will also follow new criteria.

The assessment and classification of officials and public employees from 2020 will be conducted in the following four levels:
- Outstanding mission accomplishment;
- Good mission accomplishment;
- Mission accomplishment;
- Mission incompletion.
Previously, Decree 56/2015/ND-CP stipulated that the assessment and classification of officials and public employees should follow these four levels:
- Outstanding mission accomplishment;
- Good mission accomplishment;
- Mission accomplishment but with limited capability;
- Mission incompletion.
Decree 90/2020/ND-CP has replaced the level “mission accomplishment but with limited capability” with “mission accomplishment”. Thus, the assessment of officials and public employees will clearly show whether the employee has accomplished the mission or not, without the intermediary level of mission accomplishment but with limited capability.
3. Process for Assessing and Classifying Officials and Public Employees in Vietnam

4. Notable Regulations When Assessing and Classifying Officials and Public Employees in Vietnam
(1) Officials and public employees with less than 6 months of service in the year will not be evaluated or classified for quality but must still review their service time within the year, except for those on maternity policy leave (according to Clause 3, Article 2 of Decree 90/2020/ND-CP).
(2) Officials and public employees on leave for 3 to less than 6 months within the year, as regulated by law, will still be evaluated but not classified at the level of good mission accomplishment or higher (according to Clause 3, Article 2 of Decree 90/2020/ND-CP).
(3) Officials and public employees on maternity policy leave, as regulated by law, will have their quality classification for the year based on the actual working period of that year (according to Clause 3, Article 2 of Decree 90/2020/ND-CP).
(4) In cases where officials and public employees transfer jobs, the new agency, organization, or unit is responsible for assessment and classification; however, if the officials and public employees have worked at the previous agency, organization, or unit for 6 months or more, the assessment must be combined with feedback from the previous agency, organization, or unit, unless the previous entity no longer exists (according to Clause 1, Article 20 of Decree 90/2020/ND-CP).
(5) The results of the assessment and classification of officials and public employees will be made public within the agency, organization, or unit where they work (according to Clause 5, Article 17 of Decree 90/2020/ND-CP).
Note that the results of the assessment and classification of officials and public employees are the basis for arrangement, use, training, fostering, rank or job title promotion, planning, appointment, dismissal, transfer, secondment, commendation, discipline, evaluation, and quality classification of party members, and the implementation of other policies for officials and public employees. It can be seen that these results are very important for officials and public employees.
