According to the current regulations set forth in Circular 08/2013/TT-BNV, officials and public employees will be considered for a salary increase before due date under two circumstances. The specific cases are detailed as follows:
1. Due to outstanding achievement in performing duties
* Conditions and benefits:
Officials and public employees with outstanding achievements in performing their duties will be considered for a salary increase before due date if the following conditions are met:
- Fulfill the following 2 standards throughout the duration of holding the salary grade:- Standard 1: Evaluated by competent authorities from the level of completing duties but with limited capabilities or higher;- Standard 2: Not subjected to disciplinary action in the form of reprimand, warning, demotion, or dismissal.- Outstanding accomplishment in performing duties must be recognized in writing by competent authorities;- Have not reached the final salary grade in the rank or title;- As of December 31 of the year under consideration, there are 12 months or less remaining to be regularly eligible for a salary grade increase.
* Rate of pre-due date salary increase:
The rate of officials, public employees, and workers (excluding subjects regulated under Clause 2, Article 3 of Circular 08/2013/TT-BNV) being considered for a pre-due date salary increase due to outstanding performance in one year shall not exceed 10% of the total number of officials, public employees, and workers on the payroll list of the agency or unit. The payroll list of the agency or unit is determined according to the decision by competent authorities on staffing levels (for officials) or approval of the number of workers (for public employees and workers) as of December 31 of the year under consideration for the pre-due date salary increase.
* Number of times allowed to receive a pre-due date salary increase due to outstanding achievement:
Successive pre-due date salary increases due to outstanding achievements in the same rank or title are not allowed.
* Determining achievements for pre-due date salary increase consideration due to outstanding achievement:
- Achievements to be considered for a pre-due date salary increase are determined based on the issuance date of the recognition decision of achievements within the past 6 years for ranks and titles requiring higher education or the past 4 years for ranks and titles requiring secondary education and below, as of December 31 of the year under consideration for a pre-due date salary increase.
For those already granted a pre-due date salary increase, all achievements obtained before the effective date of the pre-due date salary increase decision within the stipulated period (6 years and 4 years) will not be considered for the next pre-due date salary increase.
- Consideration for a pre-due date salary increase is based on the highest achievement achieved by the officials and public employees and workers; if the highest achievements are equal, other achievements will be considered; in cases where several individuals have equal achievements, priority is given according to the pre-due date salary increase regulation of the agency or unit.
* Criteria for considering pre-due date salary increase:
Standards and levels for outstanding achievements in performing duties and the corresponding time periods for salary grade increases before due date for different levels of achievement by officials and public employees and workers are specified by the head of the agency or unit managing officials and public employees and workers in consultation with the party committee and executive committee of the labor union at the same level. Based on these regulations, officials and public employees and workers eligible for pre-due date salary increase are selected annually by the collective, but each year, it does not exceed 10% of the total number of officials and public employees and workers on the payroll list of the agency or unit.
2. Notice of retirement
Officials and public employees receive a salary increase before the due date when they have a notice of retirement if the following conditions are met:
- Officials and public employees must meet the following 2 standards throughout the duration of holding the salary grade. Specifically:- Standard 1: Evaluated by competent authorities from the level of completing duties but with limited capabilities or higher;- Standard 2: Not subjected to disciplinary action in the form of reprimand, warning, demotion, or dismissal.- Have not reached the final salary grade in the rank or title;- From the date of the notice of retirement to before the retirement date, there are 12 months or less remaining to be regularly eligible for a salary grade increase as per regulations.
Note: In cases where officials and public employees are both eligible for a pre-due date salary increase due to outstanding achievement in performing duties and due to a notice of retirement, the officials and public employees can choose one of the two policies for a pre-due date salary increase as regulated above.
