Upcoming, December 15, 2020 is the final deadline for agencies and public service providers to complete the evaluation of public employees for the year 2020 in Vietnam. Below are 04 things to know about the evaluation and classification of the performance quality of public employees at the end of 2020.

1. Content of evaluation and quality grading of public employees in Vietnam

Clause 5, Article 2 of the 2019 Amended and Supplemented Law on Officials, and Public Employees amends and supplements Article 41 of the 2010 Law on Public Employees detailing the evaluation content of public employees as follows:

* For public employees without managerial functions:

- Compliance with the guidelines, policies of the Vietnam Communist Party, and laws of the State as well as regulations of the agencies, organizations, and units;

- Results of work performance or tasks according to signed work contracts, set plans, or specifically assigned tasks; progress, and quality of task performance. The evaluation of task performance results must be linked to job positions, demonstrated through specific work and products;

- Compliance with professional ethics regulations;

- Sense of responsibility, attitude towards serving the people, cooperation with colleagues, and adherence to the code of conduct for public employees;

- Fulfillment of other obligations of public employees.

* For public employees with managerial functions:

- Similar evaluation contents as those without managerial functions;

- Management, administration, and task execution capabilities;

- Annual, quarterly, monthly work plans, and the operational results of the agencies, organizations, and units under their management;

- Evaluation of individual performance results linked to those of the directly supervised agencies, organizations, and units;

- Individual quality grade must not be higher than that of the directly supervised agencies, organizations, and units.

2. Order and procedures for evaluating and grading the quality of public employees in Vietnam

Article 19 of Decree 90/2020/ND-CP on the evaluation and quality grading of officials and public employees specifies the order and procedures as follows:

* For public employees who are heads and deputy heads:

- Self-evaluation and quality grading: public employees prepare reports of self-evaluation and grading of work results according to assigned responsibilities and tasks.

- Commenting and evaluating public employees:

  • Hold a meeting at the unit where the public employee works to comment and evaluate them. The meeting participants include all public employees of the unit.
  • If the unit has sub-units, the participants include the unit's leadership, representatives of the party committee, trade union, youth union of the same level, and heads of the sub-units. For large-scale units, the heads of sub-units can provide written comments.
  • The public employee presents their self-evaluation report at the meeting, and the meeting participants give their opinions, which must be recorded in the minutes and approved at the meeting.

- Gathering comments from the unit's party committee where the public employee works.

- Reviewing and deciding on the evaluation and quality grading of the public employee:

  • The advisory department on personnel work of the agency or unit with evaluation authority aggregates comments, evaluations, and related documents (if any), proposes evaluation content and quality grades for the public employee.
  • The competent authority decides on the evaluation and quality grading of the public employee.

- The competent authority notifies the public employee of the evaluation and quality grading results in writing and decides on the form of public disclosure within the agency, organization, or unit where the public employee works, prioritizing electronic disclosure.

* For public employees without managerial positions:

- Self-evaluation and quality grading: public employees prepare self-evaluation reports of work results according to assigned tasks.

- Commenting and evaluating public employees:

  • Hold a meeting at the unit where the public employee works to comment and evaluate them;
  • The meeting participants include all public employees of the unit or all public employees of the sub-unit where the public employee works in case the unit has sub-units;
  • The public employee presents their self-evaluation report at the meeting, and the meeting participants give their opinions, which must be recorded in the minutes and approved at the meeting.

- Reviewing and deciding on the evaluation and quality grading of public employees: The competent authority bases its decision on comments at the meeting to determine the evaluation content and quality grade for the public employee.

- The competent authority notifies the public employee in writing and publicly announces the results within the agency, organization, or unit where the public employee works, prioritizing electronic disclosure.

3. Timing for the annual evaluation and grading of public employees in Vietnam

Article 20 of Decree 90/2020/ND-CP stipulates that the evaluation and quality grading of public employees is conducted before December 15 each year, before performing the evaluation and quality grading of party members and summarizing annual commendation and reward activities of the agency, organization, or unit.

Note: For public service providers in education, training, and some other fields with a work year ending before December, the head of the public service provider decides on the timing for evaluating and grading the quality of public employees.

Additionally, Article 20 of Decree 90/2020/ND-CP clearly outlines the timing of the evaluation and grading in cases of justified absence, sick leave, or maternity leave according to legal provisions. In such cases, the public employee is responsible for preparing a self-evaluation report and receiving a quality grade according to their assigned responsibilities and tasks, to be submitted to the working agency, organization, or unit for evaluation and grading according to regulations.

4. Use of evaluation results

Article 21 of Decree 90/2020/ND-CP stipulates that the results of the evaluation and quality grading of public employees are the basis for arranging, using, training, fostering, promoting, or ranking occupational titles, planning, appointing, dismissing, mobilizing, rotating, seconding, rewarding, disciplining, evaluating and grading the quality of party members, and implementing other policies for public employees.
