This Decision provides detailed instructions on procedures for adjusting payment rates and issuing social insurance books in Vietnam from February 25, 2021 as follows:

(1) Implementation sequence

Step 1: Prepare and submit application

- Employees working for the employer: Prepare documents according to the provisions of point (i) section (3) Document components; submit the application to the employer.

- Workers working abroad: Prepare documents as prescribed in point (ii) section (3) Components of documents submitted through the unit sending workers to work abroad or pay directly to the social insurance agency where the employee resides before going to work abroad.

- Employees who have 2 or more social insurance books with duplicate social insurance contributions: Prepare documents according to the provisions in point (iii) section (3) Document components and submit them directly to the social insurance agency of management or place of residence.

- Employer: Record the social insurance code on the corresponding forms for employees who have been issued a social insurance code; instruct employees to prepare a Declaration of Participation and adjustment of social insurance and health insurance information (Form TK1-TS) for employees who have not yet been issued a social insurance code (including employees who do not remember their social insurance codes); submit it to the social insurance agency.

Step 2: The social insurance agency receives the application and resolves it according to regulations.

Step 3: Receive results, including: social insurance book, health insurance card; Refund decision; Reimbursement for duplicate social insurance, and unemployment insurance payments.

(2) Submission methods

Employers and workers working abroad pay directly to the social insurance agency and workers with 2 or more social insurance books with duplicate social insurance and unemployment insurance files submit the application in one of the following forms:

- Through public postal services;

- Directly at the Single-Window Department of the social insurance agency at the provincial and district levels or at the HCC Service Center at all levels.

- Through electronic transactions for employers: prepare electronic records, digitally sign and send them to the Vietnam Social Insurance Electronic Information Portal or via the I-VAN organization.

The settlement results are received in the registered form.

(3) Document composition

(i) For employees working at the employer who submit documents to the employer:

- Declaration for participation in adjusting social insurance and health insurance information (Form TK1-TS).

In case the employee is entitled to higher health insurance benefits: add supporting documents (if any) according to Appendix 03.

(ii) For workers working abroad:

- Declaration of participation and adjustment of social insurance and health insurance information (Form TK1-TS);

- A fixed-term labor contract abroad or a renewed labor contract accompanied by a written extension of the labor contract or a new labor contract signed in the country receiving the labor under the contract.

(iii) For employees with 2 or more social insurance books whose social insurance and unemployment insurance payment periods overlap:

- Declaration of participation and adjustment of social insurance and health insurance information (Form TK1-TS);

- Social insurance books.

(iv) For employers:

- Declaration of participating units and adjustment of social insurance and health insurance information (Form TK3-TS);

- Report on employment situation and list of participants in social insurance, health insurance, and unemployment insurance (Form D02-LT);

- Information list (Form D01-TS).

(4) Number of documents: 1 set

(5) Processing time: From the date the social insurance agency receives complete documents according to regulations:

- In case of issuance of new social insurance books and health insurance cards: No more than 5 days.

- In case of temporary suspension of contributions to the retirement or survivorship fund: No more than 5 days.

- In case of violation of legal regulations on social insurance, health insurance, unemployment insurance, occupational accident insurance, and occupational disease insurance: No more than 10 days.

- In case of adjusting the salary increase for social insurance, health insurance, unemployment insurance, occupational accident insurance, and occupational disease insurance: No more than 3 days.

- In case of social insurance book confirmation: no more than 05 days.

- In case of refund due to duplicate payments of social insurance and unemployment insurance: no more than 10 days.
