Decree 146 Issuing New Guidelines on the Health Insurance Law

the Government of Vietnam has officially passed Decree 146/2018/ND-CP detailing the Law on Health Insurance, replacing previous documents.

Decree 146 stipulates the procedures for medical examination and treatment covered by health insurance for participants as follows:

- When visiting for medical examination and treatment, the insured must present a health insurance card with a photo. If the health insurance card does not have a photo, one of the following documents must be presented:

- An identification document with a photo issued by a competent authority or organization;- A confirmation letter from the Commune Police;- Other documents with a confirmation from the educational institution managing the students;

And other legally accepted identification documents.

For children under 06 years old visiting for medical examination and treatment, only the health insurance card needs to be presented. If the child has not been issued a health insurance card, a copy of the birth certificate or birth registration must be presented. In cases where immediate treatment is required after birth and a birth certificate has not yet been issued, the head of the medical examination and treatment facility along with the child's parents or guardians will sign the confirmation in the medical record to serve as a basis for payment under Clause 1 Article 27 of this Decree and will take responsibility for that confirmation.

Decree 146/2018/ND-CP takes effect from December 1, 2018, replacing the following documents and provisions:

- Decree 105/2014/ND-CP providing guidance on the Law on Health Insurance;- Joint Circular 41/2014/TTLT-BYT-BTC providing guidance on the implementation of health insurance;- Joint Circular 16/2015/TTLT-BYT-BTC providing guidance on policies of the Law on Professional Military Personnel, Defense Workers and Public Employees;- Article 8 and Clause 2 Article 9 Decree 151/2016/ND-CP providing guidance on policies of the Law on Professional Military Personnel, Defense Workers and Public Employees;- Clause 6 Article 11, Point c Clause 1 and Clause 2 Article 12 Circular 40/2015/TT-BYT regulating initial health insurance medical examination and treatment registration and referral for health insurance medical examination and treatment.
