The Government of Vietnam is drafting a Decree amending and supplementing a number of articles of Decree 28/2015/ND-CP to guide the Law on Employment regarding Unemployment Insurance (UI) in Vietnam.
Draft Decree has amended and supplemented several specific contents as follows:
1. Increase the support level for vocational training, fostering, and skill enhancement in Vietnam to maintain employment for employees, with a maximum support level of VND 1.5 million/person/month (the current level is VND 1 million/person/month).
2. Add more cases where employees in Vietnam are identified as paying unemployment insurance according to the provisions of Article 49 of the Employment Law:
- Employees who have paid unemployment insurance for the month they terminate their labor contract or working contract and are confirmed by the social insurance agency;
- Employees who have, in the month immediately preceding the month of termination of the labor contract or working contract, taken unpaid leave or suspended the labor contract or working contract for 14 or more working days in a month and are confirmed by the social insurance agency;
- Employees who have a period of unemployment insurance payment before receiving unemployment benefits that has not been confirmed, when the social insurance agency subsequently confirms this period, it will be considered as the unemployment insurance payment period that has not received unemployment benefits according to the Ministry of Labor, War Invalids, and Social Affairs.

3. Add new regulations on submitting applications for unemployment benefits in Vietnam, whereby, within 15 working days from the date of submitting the application for unemployment benefits, if the employee does not wish to receive unemployment benefits, the employee must directly or authorize another person to submit a request not to receive unemployment benefits to the employment service center where the employee has submitted the unemployment benefits application. The first day of the 15-day period is the day the employee submits a complete application.
4. Add new regulations on suspending the receipt of unemployment benefits in Vietnam
To be specific:
- During the suspension period of unemployment benefits, employees will not receive unemployment benefits. The unemployment insurance payment period corresponding to the number of months that employees are suspended from receiving unemployment benefits will not be preserved as a basis for calculating the period for receiving unemployment benefits for the next time when they meet the conditions according to the regulations;
- During the suspension period of unemployment benefits, employees are entitled to request vocational training, vocational support, and enjoy health insurance benefits.
