Issuance of a circular guiding 27 new professional civil servant positions in the construction industry in Vietnam
On October 20, 2023, the Minister of Construction signed and issued Circular 11/2023/TT-BXD guiding the positions of professional civil servants in the construction industry as follows:

What are principles and grounds to build a list of professional civil servants in the construction industry in Vietnam?
Pursuant to Article 3 of the Circular 11/2023/TT-BXD stipulating principles and grounds to build a list of professional civil servants in the construction industry in Vietnam as follows:
Principles and grounds for determining the positions of professional civil servants in the construction industry
1. Principles for determining the positions of professional civil servants in the construction industry are carried out according to the provisions of Article 3 of Decree 62/2020/NĐ-CP dated June 1, 2020 of the Government on positions and civil servant establishment.
2. Grounds for determining the positions of professional civil servants in the construction industry are carried out according to the provisions of Clause 1, Article 4 of Decree 62/2020/NĐ-CP dated June 1, 2020 of the Government on positions and civil servant establishment.
As regulations above, to build a list of positions of professional civil servants in the construction industry, it is necessary to comply with the following principles and grounds:
[1] Principles for determining the positions of professional civil servants in the construction industry are carried out according to the provisions of Article 3 of Decree 62/2020/NĐ-CP, including:
- Compliance with the regulations of the Party, of the law on positions, management, and use of civil servant establishment.
- Suitability with the functions, tasks, powers, and organizational structure of the agency or organization.
- Ensuring consistency and coordination between determining the positions, civil servant grade structure, with the use and management of civil servant establishment.
- Ensuring scientificity, objectivity, transparency, democracy, and compliance with reality.
- Linking the reduction of civil servant establishment with the restructuring and improving the quality of the civil servant corps in agencies and organizations.
[2] Grounds for determining the positions of professional civil servants in the construction industry are carried out according to the provisions of Clause 1, Article 4 of Decree 62/2020/NĐ-CP, including:
- The functions, tasks, powers, organizational structure of the agency or organization.
- The level of complexity, nature, characteristics, scale of activities; scope, objects of service; the process of professional and technical management according to the provisions of specialized laws.
When should the positions of professional civil servants in the construction industry in Vietnam be adjusted?
Pursuant to Article 9 of the Decree 62/2020/NĐ-CP stipulating adjustment of positions as follows:
Adjustment of positions
1. The adjustment of positions in an agency or organization is carried out in the following cases:
a) The agency or organization has a change in one of the grounds specified in Clause 1, Article 4 of this Decree;
b) The agency or organization is reorganized by a decision of the competent authority.
2. The procedures and documents for adjusting positions in an agency or organization are carried out in accordance with the provisions of Articles 7 and 8 of this Decree, together with a document from the competent authority related to the adjustment of positions.
As regulations above, the positions of professional civil servants in the construction industry need to be adjusted when they fall into one of the following cases:
- The agency or organization has a change in one of the following grounds:
+ The functions, tasks, powers, and organizational structure of the agency or organization;
+ The level of complexity, nature, characteristics, scale of activities; scope, objects of service; the process of professional and technical management according to the provisions of specialized laws.
- The agency or organization is reorganized by a decision of the competent authority.
Note: Circular 11/2023/TT-BXD takes effect from 05/12/2023.
