Is it permissible to borrow a construction practice certificate?
According to Point c, Clause 2, Article 65 of Decree 15/2021/ND-CP, which stipulates the obligations of individuals applying for a construction practice certificate, as follows: "It is prohibited to lease, lend, or allow others to use the issued practice certificate;"
Moreover, Point c, Clause 2, Article 63 of this Decree also stipulates that in the event an individual leases, lends, rents, borrows, or allows others to use their practice certificate, such certificate will be revoked.
Points b, Clause 1, Point a, Clause 4, Point a, Clause 5, Article 23 of Decree 139/2017/ND-CP stipulate as follows:
- A fine ranging from 10,000,000 VND to 20,000,000 VND shall be imposed on individuals practicing construction activities who commit one of the following acts:
b) Borrowing, lending, renting, or leasing a practice certificate for construction activities;
- Additional Penalties:
a) Suspension of the practice certificate for a period ranging from 06 months to 12 months for acts prescribed in Points a and b, Clause 1 of this Article;
- Remedial Measures:
a) Notify the certifying agency to revoke or annul the practice certificate according to regulations for the act prescribed in Point b, Clause 1 of this Article.
Thus, the act of borrowing a construction practice certificate is prohibited. In case you borrow someone else's practice certificate, you can be fined up to 20,000,000 VND, and be subject to additional penalties and remedial measures mentioned above.
