Is a Person Serving a Suspended Sentence Eligible to Take the Certification Exam for Real Estate Brokerage?

Are individuals on probation allowed to take the exam for the real estate brokerage practice certificate?

Pursuant to Article 9 of Circular 11/2015/TT-BXD, the conditions for the exam are regulated as follows:

Candidates must meet the following conditions:

1. Have full civil capacity, not being subject to criminal prosecution or serving a prison sentence;

2. Have graduated from high school or above;

3. Have submitted the application for the exam and paid the exam fee to the organizing unit according to the regulations of this Circular.

Pursuant to Article 1 of Resolution 02/2018/NQ-HDTTP, the probation is defined as follows:

Probation is a conditional suspension of a prison sentence, applied by the Court to a person convicted with a prison sentence of no more than 03 years, based on the offender's personal history and mitigating circumstances, considering it unnecessary for them to serve the prison sentence.

You are currently on probation, meaning you are conditionally exempt from serving a prison sentence, and meet the condition of not being subject to criminal prosecution or serving a prison sentence. Therefore, you are eligible to take the exam for the real estate brokerage practice certificate.

What documents are required for the application to take the exam for the real estate brokerage practice certificate?

Pursuant to Article 10 of the aforementioned Circular, the application documents required to take the exam for the real estate brokerage practice certificate are as follows:

1. 01 application form with a color photo size 4x6cm taken within 06 months from the date of exam registration (as per the template in Appendix 1 of this Circular);

2. 01 certified copy of the ID card for Vietnamese individuals or passport for foreigners (or a copy with the original for comparison);

3. 01 certified copy of the certificate of completion of a training course on real estate brokerage practice knowledge (if any);

4. Copy (certified) of the high school diploma (or equivalent) or higher;

5. 02 color photos size 4x6cm taken within 06 months from the date of exam registration, 02 stamped envelopes with the recipient's name, phone number, and address;

6. Certified copies and translations of certificates issued abroad (for foreigners and Vietnamese individuals with a valid real estate brokerage practice certificate issued abroad).
