What are the conditions for vehicle operators participating in road traffic in Vietnam?
Based on Article 56 of the Road Traffic Safety and Order Law 2024, the conditions for vehicle operators participating in road traffic are defined as follows:
[1] Drivers participating in road traffic
- Must meet age and health requirements as prescribed by law.
- Must have a valid driver license with points remaining, suitable for the type of vehicle being operated, issued by a competent authority, except for motorbike riders.
- Must carry the following documents:
+ Vehicle registration certificate or a certified copy of the vehicle registration certificate accompanied by the original confirmation documents of the financial institution or foreign bank branch still valid in the case the vehicle is mortgaged at a financial institution or foreign bank branch.
+ A valid driver license suitable for the type of vehicle being operated.
+ Vehicle technical safety and environmental protection inspection certificate for motor vehicles as prescribed by law.
+ Compulsory civil liability insurance certificate for motor vehicle owners.
[2] Operators of special-use motor vehicles
- Must meet age and health requirements as prescribed by law.
- Must possess a license or certificate to operate special-use motor vehicles suitable for the type of special-use motor vehicle being operated.
- Must have a valid driver license with points remaining or a certificate of road traffic law knowledge.
- Must carry the following documents:
+ Vehicle registration certificate or a certified copy of the vehicle registration certificate accompanied by the original confirmation document of the financial institution, foreign bank branch, still valid, in case the vehicle is mortgaged at a financial institution or foreign bank branch.
+ License or certificate to operate special-use motor vehicles.
+ driver license or certificate of road traffic law knowledge.
+ Vehicle technical safety and environmental protection inspection certificate for special-use motor vehicles as prescribed by law.
+ Compulsory civil liability insurance certificate as prescribed by law.
[3] Motorcycle riders
- Must have knowledge of road traffic rules and possess vehicle operating skills.
- Persons 16 years or older are allowed to operate motorcycles.
- Must ensure health conditions suitable for each type of permitted vehicle.
[4] Learner drivers and driving test candidates
- Must practice on training vehicles and testing routes, supervised by a driving instructor or examiner.
- Driving instructors and examiners must carry the following documents:
+ Vehicle registration certificate or a certified copy of the vehicle registration certificate accompanied by the original confirmation document of the financial institution or foreign bank branch still valid in the case the vehicle is mortgaged at a financial institution or foreign bank branch.
+ Valid driver license suitable for the type of vehicle being operated.
+ Vehicle technical safety and environmental protection inspection certificate for motor vehicles as prescribed by law.
+ Compulsory civil liability insurance certificate for motor vehicle owners.
At what age is one allowed to operate a motorcycle in Vietnam?
Based on Article 59 of the Road Traffic Safety and Order Law 2024 stipulating the age and health requirements for operators of road traffic vehicles:
Article 59. Age and health of vehicle operators participating in road traffic
- The age of drivers and operators of special-use motor vehicles is regulated as follows:
a) Persons aged 16 and above are allowed to operate motorcycles;
b) Persons aged 18 and above are eligible for an A1, A, B1, B, C1 driver license or a certificate of road traffic law knowledge to operate special-use motor vehicles on roads;
c) Persons aged 21 and above are eligible for a C, BE driver license;
d) Persons aged 24 and above are eligible for a D1, D2, C1E, CE driver license;
dd) Persons aged 27 and above are eligible for a D, D1E, D2E, DE driver license;
e) The maximum age for drivers of passenger cars (including buses) with more than 29 seats (excluding the driver's seat) and sleeper buses is 57 years for men and 55 years for women.
