At Point l Clause 2 Article 6 of Decree 100/2019/ND-CP amended by Point k Clause 34 Article 2 of Decree 123/2021/ND-CP, it is stipulated that penalties imposed upon operators of mopeds and motorcycles (including electric motorcycles) and the like violating road traffic rules are as follows:

2. A fine ranging from VND 300,000 to VND 400,000 shall be imposed upon a vehicle operator who commits any of the following violations:

l) Carrying two people on a vehicle, unless a person being carried is a person who needs urgent medical care, a child under 14 years of age, or a criminal being escorted;

According to Point o Clause 3 Article 6 of Decree 100/2019/ND-CP supplemented by Point b Clause 4 Article 2 of Decree 123/2021/ND-CP, penalties imposed upon operators of mopeds and motorcycles (including electric motorcycles) and the like violating road traffic rules are as follows:

3. A fine ranging from VND 400,000 to VND 600,000 shall be imposed upon a vehicle operator who commits any of the following violations:

...

o) Carrying a person who does not wear a motorcycle helmet or does not wear the motorcycle helmet properly, unless that person is a patient who needs urgent medical care, a child under 06 years of age, or a criminal being escorted.

Therefore, in the case of transporting 2 people on a motorcycle and transporting a passenger without wearing a helmet, both are subject to penalties, but if it is a case of transporting a patient for urgent medical care, there is no violation of the law in Vietnam. Transporting 2 people for urgent medical care without wearing a helmet will not be fined.

What are penalties for not wearing a helmet in Vietnam in 2022?

Based on Clause 3 Article 6 of Decree 100/2019/ND-CP supplemented by Point b Clause 4 Article 2 of Decree 123/2021/ND-CP, penalties imposed upon operators of mopeds and motorcycles (including electric motorcycles) and the like violating road traffic rules are as follows:

3. A fine ranging from VND 400,000 to VND 600,000 shall be imposed upon a vehicle operator who commits any of the following violations:

a) Turning without slowing down or signaling (unless going along a curved segment where there is no level crossing);

b) Carrying 03 people or more on the vehicle;

c) Continuously honking, revving the engine in urban areas or residential areas, except for the emergency vehicles on duty;

d) Stopping or parking on a bridge;

...

m) Failure to turn on low beam while operating the vehicle in a road tunnel.

n) Failure to wear a motorcycle helmet properly or wearing it improperly;

o) Carrying a person who does not wear a motorcycle helmet or does not wear the motorcycle helmet properly, unless that person is a patient who needs urgent medical care, a child under 06 years of age, or a criminal being escorted.

Therefore, the fine for not wearing a helmet is from 400,000 to 600,000 VND. The fine in 2022 is double the previous fine in 2020.
