Pursuant to Article 11 of the Decree 32/2023/TT-BCA stipulating undercover patrols and inspections in public as follows:

Undercover patrols and inspections in public

1. A traffic police team is assigned a team of disguised officers (in plain clothes), working together with the team of public patrol and inspection officers according to a plan issued by the competent authority under the provisions of Clause 3 of this Article to carry out the tasks of patrol, inspection, and handling violations on the route, area assigned.

The disguised officer team has the task of directly observing, using technical equipment to monitor the situation of traffic order and safety, detecting violations of traffic laws and other violations of the law; when detecting violations, they must immediately inform the public patrol and inspection team to proceed with stopping the vehicle, inspecting, and handling in accordance with regulations. In case of detecting serious violations of traffic order and safety, social security, if not stopped in time, it will cause dangerous consequences for society, causing damage to property of agencies, organizations, individuals, and harming the lives and health of road users, then use the Police Officer Identification Card to inform and mobilize people to cooperate, immediately prevent the violation; report and coordinate with the public patrol and inspection team to resolve at the place of detection of the violation or take the violator to the nearest police station for handling in accordance with regulations.

Therefore, from August 15, 2023, traffic police in plain clothes (disguised officers) if they discover serious violations that can not be stopped in time will cause dangerous consequences, they are allowed to use the Police Officer Identification Card to inform and mobilize people to cooperate, immediately prevent traffic violations.

Who have the authority to impose decision on undercover patrols and inspections in public in Vietnam?

Pursuant to Clause 3 Article 11 of the Decree 32/2023/TT-BCA stipulating the authority to impose decision on undercover patrols and inspections in public in Vietnam as follows:

Undercover patrols and inspections in public

1. A traffic police team is assigned a team of disguised officers (in plain clothes), working together with the team of public patrol and inspection officers according to a plan issued by the competent authority under the provisions of Clause 3 of this Article to carry out the tasks of patrol, inspection, and handling violations on the route, area assigned.

2. Cases of undercover patrols and inspections in public include:

a) Using technical equipment to improve the effectiveness of traffic safety and order work;

b) Fighting crime; complex security and order or traffic safety and order situations.

3. Authority to decide undercover patrols and inspections in public

a) The Director of the Traffic Police Department; Provincial Police Chiefs and above decide to patrol and inspect publicly combined with disguise specified in Clause 2 of this Article;

b) The Head of the Traffic Guidance and Inspection Department for Road Traffic, Railways; Head of the Traffic Police Department; District Police Chiefs decide to undercover patrols and inspections in public for cases specified in Point a, Clause 2 of this Article.
