The Law on Telecommunications in 2023 has 10 Chapters and 73 Articles and will come into effect on July 1, 2024.

What are prohibited acts in telecommunications activities in Vietnam?
Article 9 of the Law on Telecommunications in 2023 prohibits the following acts in telecommunications activities:
(1) Taking advantage of telecommunications activities to oppose the Socialist Republic of Vietnam; infringing upon national security, social order and safety, causing damage to the interests of the State, the legitimate rights and interests of organizations and individuals.
(2) Illegally intercepting, listening to, or viewing information on telecommunications networks; stealing, using illegally telecommunications resources, passwords, encryption keys, and private information of other organizations and individuals.
(3) Illegally obstructing the establishment of telecommunications infrastructure, causing disruption or sabotage to the establishment of telecommunications infrastructure, the provision and legal use of telecommunications services.
(4) Establishing telecommunications infrastructure, providing telecommunications services without prior authorization in accordance with the provisions of this Law.
(5) Using devices or software to send, transmit, or receive information over telecommunications networks to commit acts that violate the law.
What information is prioritized for transmission over telecommunications networks in Vietnam?
Article 7 of the Law on Telecommunications in 2023 provides for the following information that is prioritized for transmission over telecommunications networks:
(1) Emergency information for national defense, security, and defense.
(2) Emergency information for search and rescue, relief, disaster prevention, fire prevention, and other disasters.
(3) Emergency information for disease prevention and control.
(4) Other cases as prescribed by the law on emergency situations.
What are principles for the development of the national telecommunications development planning in Vietnam?
Article 8 of the Law on Telecommunications in 2023 stipulates the following principles for the development of the national telecommunications development planning:
Principles for the development of the national telecommunications development planning
1. The national telecommunications development planning is integrated into the information and communication infrastructure planning to determine the goals, principles, orientations for the development of the telecommunications market, telecommunications infrastructure, technology, telecommunications services, and implementation solutions.
2. The development of the national telecommunications development planning shall be carried out in accordance with the following principles:
a) Conformity with the strategy, national-level planning, and socio-economic development plans of the country in each period; compliance with Vietnamese law, international treaties to which the Socialist Republic of Vietnam is a member.
b) Conformity with the trend of convergence of telecommunications technology and services; creating conditions for the application of new technologies and advanced technologies.
c) Ensuring the effective, efficient, and proper management, exploitation, and use of telecommunications resources.
d) Ensuring sustainable and harmonious telecommunications development; narrowing the gap in telecommunications development between regions and provinces.
dd) Environmental protection, ensuring the safety of telecommunications infrastructure and information security.
3. Based on the information and communication infrastructure planning, regional planning, provincial planning, and technical and specialized planning related to, telecommunications enterprises shall develop the planning and plans of their businesses.
Therefore, the principles for the development of the national telecommunications development planning are as follows:
- Compliance with the strategy, national-level planning, and socio-economic development plans of the country in each period; compliance with Vietnamese law, international treaties to which the Socialist Republic of Vietnam is a member.
- Conformity with the trend of convergence of telecommunications technology and services; creating conditions for the application of new technologies and advanced technologies.
- Ensuring the effective, efficient, and proper management, exploitation, and use of telecommunications resources.
- Ensuring sustainable and harmonious telecommunications development; narrowing the gap in telecommunications development between regions and provinces.
- Environmental protection, ensuring the safety of telecommunications infrastructure and information security.
