Seizure of Assets of Commercial Legal Entities Under Lease: Is it Permissible?
Pursuant to Article 22 of Decree 44/2020/ND-CP (Effective June 1, 2020) stipulating the seizure of assets of a commercial legal entity held by a third party as follows:
- In case it is determined that a third party is holding assets of a commercial legal entity, including assets determined by judgment or other decision, the competent criminal enforcement agency shall issue a decision to seize those assets; if the third party does not voluntarily hand over the assets, the competent criminal enforcement agency may enforce a seizure compelling them to hand over the assets for enforcement.
- In case the seized assets are being leased, the lessee may continue the lease according to the entered contract.
=> Thus, the criminal enforcement agency has the right to seize the assets of a commercial legal entity that are being leased to ensure the enforcement of the judgment. However, you are still entitled to continue the lease according to the entered contract without affecting your rights.
